                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the funding of the
     3     Catastrophic Loss Trust Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1762 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1762.  Funding.
     9     The Catastrophic Loss Trust Fund shall be funded by levying
    10  an initial charge of $5 upon all motor vehicles required to be
    11  registered under Chapter 13 (relating to registration of
    12  vehicles) except trailers, recreational vehicles not intended
    13  for highway use, motorcycles, motor-driven cycles, motorized
    14  pedalcycles or like type vehicles. This charge shall be
    15  [remitted to an insurance company or other party as may be
    16  designated by the Insurance Department. Upon receipt of the
    17  charge, the insurance company or other designated party shall
    18  remit it to the Insurance Department for deposit in the trust

     1  fund.] collected by the Department of Transportation at the same
     2  time as registration fees are collected, and by it remitted to
     3  the Insurance Department for deposit in the trust fund. The
     4  Catastrophic Loss Trust Fund Board shall, by regulation,
     5  determine by January 1 of each calendar year the amount of the
     6  fund charge for each registration year subsequent to the initial
     7  registration year and shall notify the Insurance Department
     8  [which shall notify the insurance companies or other designated
     9  parties to collect the charge].
    10     Section 2.  This act shall take effect January 1, 1986.
