AN ACT 1 Authorizing and directing the Department of General Services, 2 with the approval of the Governor and the Department of 3 Environmental Resources, to convey a tract of land and a 4 right-of-way in Noyes Township, Clinton County, Pennsylvania. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The Department of General Services, with the 8 approval of the Governor and the Department of Environmental 9 Resources, is hereby authorized and directed, on behalf of the 10 Commonwealth of Pennsylvania, to grant and convey to Ellis E. 11 Rhodes and Thomas E. Rhodes, both of Altoona, Pennsylvania, the 12 following tract of land situate in Noyes Township, Clinton 13 County, Pennsylvania, together with a right-of-way for access 14 thereto, which tract and right-of-way are bounded and described 15 as follows: 16 All that certain parcel of land situate in Noyes Township, 17 Clinton County, Pennsylvania, bounded and described as follows: 18 That portion of the abandoned Beech Creek Extension Railroad
1 right-of-way, said right-of-way being 100 feet in width and 2 extending in a general northwesterly direction, more or less, 3 parallel to the Susquehanna River and approximately 15 rods 4 south of the north line of a parcel previously conveyed to Ellis 5 E. Rhodes, et ux., by the Commonwealth by deed dated March 13, 6 1959, and recorded in Clinton County Deed Book 189, Page 411. 7 Said parcel contains one acre 88 perches and is the exception in 8 the deed out of the 14 acres 136 perches tract conveyed by the 9 Commonwealth to Ellis Rhodes, et ux., in the above referred to 10 deed. 11 The purpose of this conveyance is to convey any interest the 12 Commonwealth may have in said parcel to Ellis E. Rhodes and 13 Thomas E. Rhodes. 14 The Commonwealth further grants and conveys to Ellis E. 15 Rhodes and Thomas E. Rhodes, their heirs and assigns, the right 16 of ingress, egress and regress to the above described parcel 17 over the lands of the Commonwealth. Said right-of-way is of 18 vehicular size running approximately parallel to the Susquehanna 19 River. This right-of-way shall traverse lands owned by the 20 Commonwealth and described in deeds recorded in Clinton County 21 Deed Book 72, Page 39, and Deed Book 242, Page 267. 22 Section 2. The conveyance shall be made under and subject to 23 all easements, servitudes and rights of others, including, but 24 not confined to streets, roadways and rights of any telephone, 25 telegraph, water, electric, sewer, gas or pipeline companies, as 26 well as under and subject to any interest, estates or tenancies 27 vested in third persons, whether or not appearing of record, for 28 any portion of the land or improvements erected thereon. 29 Section 3. The deed of conveyance shall be approved as 30 provided by law and shall be executed by the secretary of 19850H1785B2294 - 2 -
