                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for driver's license
     3     examinations.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1508 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1508.  Examination of applicant for driver's license.
     9     (a)  General rule.--Every applicant for a driver's license
    10  shall be examined for the type or class of vehicles that the
    11  applicant desires to drive. The examination shall include a
    12  physical examination, a screening test of the applicant's
    13  eyesight and a test of the applicant's ability to read and
    14  understand official traffic-control devices, knowledge of safe
    15  driving practices and the traffic laws of this Commonwealth, and
    16  shall include an actual demonstration of ability to exercise
    17  ordinary and reasonable control in the operation of a motor
    18  vehicle of the type or class of vehicles for which the applicant


     1  desires a license to drive. An applicant for a Class 3 license
     2  shall be tested for demonstrated ability by a member of the
     3  Pennsylvania State Police who has a Class 3 license. If an
     4  applicant for a Class 3 license requests testing at the site of
     5  the applicant's employment, the testing for demonstrated ability
     6  shall take place at the site of the applicant's employment. If
     7  the department finds it necessary to further determine an
     8  applicant's fitness to operate a motor vehicle safely upon the
     9  highways the department may require one or more of the following
    10  types of examinations:
    11         (1)  A vision examination by an optometrist or
    12     ophthalmologist.
    13         (2)  A physical examination.
    14         (3)  A mental examination.
    15     (b)  Issuance of license to licensed nonresident.--A driver's
    16  license may be issued to a person who has not had a learner's
    17  permit but who at the time of application is of sufficient age
    18  and has a valid driver's license issued by another state under a
    19  law requiring the examination and licensing of drivers,
    20  providing that the applicant demonstrates knowledge and
    21  understanding of rules of the road and official traffic-control
    22  devices and is visually, physically and mentally fit. Also, the
    23  department must be satisfied that the applicant's experience in
    24  driving vehicles which may be driven by holders of the classes
    25  of licenses sought by the applicant is sufficient to justify the
    26  issuance of the license without further behind-the-wheel
    27  training.
    28     Section 2.  This act shall take effect in 60 days.
