                                     AN ACT

     1  Amending the act of June 14, 1961 (P.L.324, No.188), entitled
     2     "An act relating to the establishment, operation and
     3     maintenance of the State Library and public libraries in the
     4     Commonwealth; amending, revising, consolidating and changing
     5     the laws relating thereto; imposing duties upon public
     6     officers; providing for State and local cooperation and
     7     assistance in the establishment and maintenance of libraries;
     8     prescribing penalties; and repealing existing laws," further
     9     providing for library circulation records.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 428 of the act of June 14, 1961 (P.L.324,
    13  No.188), known as The Library Code, added June 27, 1984 (P.L.
    14  431, No.90), is amended to read:
    15     Section 428.  Library Circulation Records.--Records related
    16  to the circulation of library materials which contain the names
    17  or other personally identifying details regarding the users of
    18  the State Library or any local library which is established or
    19  maintained under any law of the Commonwealth or the library of
    20  any university, college or educational institution chartered by
    21  the Commonwealth or the library of any public school or branch

     1  reading room, deposit station or agency operated in connection
     2  therewith, shall be confidential and shall not be made available
     3  to anyone except by a court order in a criminal proceeding.
     4  Nothing in this section shall prohibit public school librarians
     5  from keeping a record with the names of students and the
     6  materials they have borrowed. Such records may be made available
     7  to school district instructional and administrative personnel
     8  for the purposes of monitoring student reading progress,
     9  required course assignments, and timely return of library
    10  materials.
    11     Section 2.  This act shall take effect immediately.
