AN ACT 1 Amending the act of June 1, 1945 (P.L.1242, No.428), entitled 2 "An act relating to roads, streets, highways and bridges; 3 amending, revising, consolidating and changing the laws 4 administered by the Secretary of Highways and by the 5 Department of Highways relating thereto," further providing 6 for the responsibilities of the Department of Transportation. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 401 of the act of June 1, 1945 (P.L.1242, 10 No.428), known as the State Highway Law, is amended to read: 11 Section 401. Duty on Department of [Highways] 12 Transportation.--(a) The department shall construct or improve, 13 and thereafter maintain and repair, at the cost and expense of 14 the Commonwealth, the highways forming the plan or system of the 15 State highways, in the several counties and [townships] 16 municipalities. Such improvement and maintenance shall be made 17 according to specifications to be prepared by the department, as 18 regards the character, construction, and material to be used. 19 The work of construction and maintenance of said State highways
1 shall be done under the direction and supervision of the 2 secretary. The secretary, in addition to the powers conferred 3 upon him in this act, shall enjoy and possess, in the 4 construction and maintenance of State highways, all the rights 5 and powers conferred by existing laws on supervisors or 6 commissioners in townships in the construction or maintenance of 7 township roads. 8 (b) In addition to the duties imposed on the department in 9 subsection (a), the department shall also be responsible for the 10 construction and maintenance of all State highways wherever 11 situate, including all roadway surfaces and including ditches, 12 curbing and storm sewers. The department shall be responsible 13 for all damage caused by water runoff from a State highway 14 unless all surface water runoff from a State highway is 15 conducted in accordance with the regulations regarding storm 16 water management. 17 Section 2.
