AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, providing for protective headgear for pedalcycle
3 riders.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 3510. Protective headgear for pedalcycle riders.
9 (a) General rule.--A person shall not operate or ride upon a
10 pedalcycle, including a cart or other device towed by a
11 pedalcycle, unless he is wearing protective headgear which
12 complies with standards established by the department.
13 (b) Exceptions.--This subsection does not apply to any of
14 the following:
15 (1) Pedalcycles operated by persons over 16 years of age
16 or older on a roadway subject to a speed limit not exceeding
17 35 miles per hour.
18 (2) Pedalcycles operated by persons under 17 years of
1 age on playgrounds or school yards.
2 (c) Approval of equipment.--The department may approve or
3 disapprove protective headgear required under this section and
4 may issue and enforce regulations establishing standards and
5 specifications for the approval of the headgear. The department
6 shall publish lists of all protective headgear by name and type
7 which has been approved.
8 Section 2. This act shall take effect in 60 days.
