                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the issuance of a junior
     3     driver's license only upon completion of a standardized
     4     driver training course.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1503(c) of Title 75 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 1503.  Persons ineligible for licensing.

    11     (c)  Junior driver's license.--The department may issue a
    12  junior driver's license only to a person 16 or 17 years of age
    13  who has successfully completed a standardized driver training
    14  course approved by the Department of Education under rules and
    15  regulations adopted by the department and subject to the
    16  provisions of this section. A junior driver's license shall
    17  automatically become a regular driver's license when the
    18  licensee attains 18 years of age.


     1         (1)  Except as provided in paragraph (2), no licensed
     2     junior driver shall drive a vehicle upon a public highway
     3     between 12 midnight and 5 a.m. unless accompanied by a spouse
     4     18 years of age or older, a parent or a person in loco
     5     parentis.
     6         (2)  A licensed junior driver conforming to the
     7     requirements of section 1507 (relating to application for
     8     driver's license or learner's permit by minor) may drive a
     9     vehicle upon a public highway between 12 midnight and 5 a.m.
    10     between their home and their activity or employment or in the
    11     course of their activity or employment if they are a member
    12     of a volunteer fire company authorized by the fire chief to
    13     engage in fighting fires, engaged in public or charitable
    14     service or employed and they are carrying an affidavit signed
    15     by their fire chief, supervisor or employer indicating the
    16     probable schedule of their activities. Upon termination of
    17     the junior driver's activity or employment, the junior
    18     licensee shall surrender the affidavit to the fire chief,
    19     supervisor or employer. If the junior licensee shall fail to
    20     surrender the affidavit, the employer, fire chief or
    21     supervisor shall immediately notify the Pennsylvania State
    22     Police.
    23         (3)  In addition to the other provisions of this title
    24     relating to the suspension or revocation of operating
    25     privileges, in the event that a licensed junior driver is
    26     involved in an accident for which they are partially or fully
    27     responsible in the opinion of the department or is convicted
    28     of any violation of this title, the department may suspend
    29     the operating privileges of such person until the person
    30     attains 18 years of age or for a period of time not exceeding

     1     90 days.
     2         (4)  Any junior licensee or other person violating any
     3     provision of this subsection is guilty of a summary offense.
     4     Section 2.  This act shall take effect in 60 days.
