                                     AN ACT

     1  Amending the act of July 9, 1976 (P.L.817, No.143), entitled "An
     2     act relating to mental health procedures; providing for the
     3     treatment and rights of mentally disabled persons, for
     4     voluntary and involuntary examination and treatment and for
     5     determinations affecting those charged with crime or under
     6     sentence," further providing for payment of costs for
     7     treatment.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 408 of the act of July 9, 1976 (P.L.817,
    11  No.143), known as the Mental Health Procedures Act, added
    12  November 26, 1978 (P.L.1362, No.324), is amended to read:
    13     Section 408.  Costs of Treatment.--[The Commonwealth shall
    14  pay for the costs, payments or expenditures in excess of $120
    15  per day made on behalf of any person who is a resident of a
    16  county located within the Commonwealth and who receives
    17  treatment and for whom liability is imposed on the county
    18  pursuant to section 505(a) of the act of October 20, 1966 (3rd
    19  Sp.Sess., P.L.96, No.6), known as the "Mental Health and Mental

     1  Retardation Act of 1966." All costs up to and including $120 per
     2  day shall be imposed upon the county of his residence. In the
     3  event that a residency cannot be determined to be in a county
     4  within the Commonwealth by the court that convicted or sentenced
     5  the person, all liability for treatment imposed by section
     6  505(a) of the "Mental Health and Mental Retardation Act of 1966"
     7  shall be borne by the Commonwealth.] (a)  Current costs.--The
     8  Commonwealth shall pay for the costs, payments or expenditures
     9  on behalf of any person who is a resident of a county located
    10  within the Commonwealth and who receives observation, treatment
    11  and for whom liability is imposed on the county pursuant to
    12  section 505 (a) and (b) of the act of October 20, 1966 (3rd
    13  Sp.Sess., P.L.96, No.6), known as the "Mental Health and Mental
    14  Retardation Act of 1966."
    15     (b)  Unpaid costs.--The Commonwealth shall pay for all
    16  charges which may be accrued and unpaid for observation,
    17  treatment and for which liability is imposed on the county
    18  pursuant to section 505 (a) and (b) of the "Mental Health and
    19  Mental Retardation Act of 1966."
    20     Section 2.  This act shall take effect in 60 days.
