                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the seizure of certain
     3     registration plates and drivers' licenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 1376 and 1540 of Title 75 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 1376.  Surrender of registration plates and cards upon
     9             suspension.
    10     (a)  General rule.--The department, upon suspending any
    11  registration, shall require the registration plate or plates and
    12  registration card to be surrendered immediately to the
    13  department and may delegate authority to any authorized
    14  department employee [or police officer] to seize the
    15  registration plate or plates and registration card or cards.
    16  Local police officers shall have the authority to take
    17  possession of any registration plate or card which has been
    18  suspended. If a local police officer receives notice from a

     1  computer-based information system that a person's registration
     2  plate or card has been suspended, he shall immediately seize the
     3  plate or card. A plate or card seized under this subsection
     4  shall be sent immediately to the department.
     5     (b)  Penalty.--Any person failing or refusing to surrender to
     6  the department, upon demand, any registration plate or card
     7  which has been suspended is guilty of a summary offense and
     8  shall, upon conviction, be sentenced to pay a fine of $100.
     9  § 1540.  Surrender of license.
    10     (a)  Conviction of offense.--Upon a conviction for any
    11  offense which calls for mandatory revocation in accordance with
    12  section 1532 (relating to revocation or suspension of operating
    13  privilege), the court or the district attorney shall require the
    14  surrender of any driver's license then held by the defendant and
    15  shall forward the driver's license together with a record of the
    16  conviction to the department.
    17     (b)  Suspension of operating privilege.--Upon the suspension
    18  of the operating privilege of any person by the department, the
    19  department shall forthwith notify the person in writing to
    20  surrender his driver's license to the department for the term of
    21  suspension.
    22     (c)  Seizure of license.--Local police officers shall have
    23  the authority to take possession of any driver's license, the
    24  surrender of which is required under subsection (a). If a local
    25  police officer receives notice from a computer-based information
    26  system that a driver's license required to be forwarded to the
    27  department has not been received, he shall immediately seize the
    28  driver's license. A driver's license seized under this
    29  subsection shall be sent immediately to the department.
    30     Section 2.  This act shall take effect in 60 days.
