                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the identification of a
     3     driver of a vehicle and for the payment of certain fines.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1553.  Duty to reveal identification of driver and pay parking
     9             fines.
    10     (a)  Agreement to reveal identity of driver.--A person to
    11  whom a vehicle is titled or registered in this Commonwealth is
    12  deemed to have agreed:
    13         (1)  To reveal the identity of the driver of the vehicle,
    14     if known, to any police officer who has reasonable grounds to
    15     believe the vehicle was involved in an accident or violation
    16     of law.
    17         (2)  To accept responsibility for any parking violation
    18     in which the vehicle is involved and make payment of any fine

     1     levied for the violation. This paragraph does not apply to
     2     persons engaged in the business of leasing or renting
     3     vehicles to persons responsible for parking violations.
     4     (b)  Suspension for refusal.--
     5         (1)  If any person to whom a vehicle is titled or
     6     registered in this Commonwealth refuses to reveal the
     7     identity of the driver of the vehicle as provided in
     8     subsection (a)(1), the department shall:
     9             (i)  suspend the registration of the vehicle or the
    10         operating privilege of the person for a period of six
    11         months; or
    12             (ii)  suspend the registration of the vehicle or the
    13         operating privilege of the person for a period of one
    14         year for a second or subsequent refusal within a period
    15         of three years.
    16         (2)  It is the duty of the police officer to inform the
    17     person that the person's operating privilege or vehicle
    18     registration will be suspended upon refusal to reveal the
    19     identity of the driver of the vehicle.
    20         (3)  A person whose operating privilege or vehicle
    21     registration is suspended under this section shall have the
    22     same right to appeal as provided for in cases of suspension
    23     for other reasons.
    24     Section 2.  This act shall take effect in 60 days.
