HOUSE RESOLUTION

        INTRODUCED BY O'DONNELL, PISTELLA, GALLAGHER, WOGAN, PERZEL,
           SALVATORE, McMONAGLE AND WESTON, MARCH 15, 1983

        HOUSE OF REPRESENTATIVES, AS AMENDED, JUNE 21, 1983

                                  A RESOLUTION

     1  Requesting Congress to conduct an investigation into the
     2     activities of the Bureau of Immigration and Naturalization
     3     relating to Michael O'Rourke.

     4     WHEREAS, Michael O'Rourke arrived in the United States of
     5  America in February 1978 from the Republic of Ireland; and
     6     WHEREAS, Michael O'Rourke lived peacefully in Philadelphia
     7  for 21 months and married an American citizen in mid 1979; and
     8     WHEREAS, Michael O'Rourke was arrested on October 30, 1979
     9  and charged with overstaying his visa; and
    10     WHEREAS, Since his arrest, Michael O'Rourke has been in
    11  continuous detention, held without bail, AND THE EVIDENCE         <--
    12  INDICATES HE HAS BEEN denied access to an attorney, denied
    13  visitors and otherwise subject to severe harassment; and
    14     WHEREAS, The public record involving Michael O'Rourke before
    15  the Federal courts and the Bureau of Immigration and
    16  Naturalization is replete with instances of INDICATES the denial  <--
    17  of the most basic of civil rights; therefore be it
    18     RESOLVED, That the House of Representatives of the

     1  Commonwealth of Pennsylvania respectfully request the Congress
     2  of the United States to begin an immediate investigation of the
     3  actions and activities of the Bureau of Immigration and
     4  Naturalization in the case of Michael O'Rourke; and
     5     RESOLVED, That the House of Representatives of the
     6  Commonwealth of Pennsylvania memorialize the Congress of the
     7  United States to STAY DEPORTATION PROCEEDINGS PENDING CONCLUSION  <--
     8  OF THE INVESTIGATION TO DETERMINE WHETHER THE BUREAU OF
     9  IMMIGRATION AND NATURALIZATION HAS VIOLATED ACCEPTABLE
    10  PROCEDURES IN THEIR DEPORTATION PROCEEDINGS OF MICHAEL O'ROURKE
    11  AND TO DETERMINE WHETHER HE IS A POLITICAL PRISONER AND grant
    12  Mr. O'Rourke political asylum, immunity from deportation and
    13  United States Citizenship IF THE CONGRESS FINDS SUCH VIOLATIONS,  <--
    14  OR FINDS MR. O'ROURKE TO BE A POLITICAL PRISONER, AND TO DIRECT
    15  FULL AND PUBLIC DISCLOSURE OF THE INVESTIGATION; and be it
    16  further
    17     RESOLVED, That copies of this resolution be transmitted to
    18  the presiding officers of each house of Congress and to each
    19  member of Congress from Pennsylvania.
