                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, making it illegal to sell certain
     3     residential property without an operable smoke detector
     4     installed therein.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 3309.  Sale of private residential property without smoke
    10             detectors.
    11     (a)  Offense defined.--A person who sells a private
    12  residential property, whether new or previously owned, without
    13  at least one operable smoke detector installed in each living
    14  unit contained therein commits a misdemeanor of the third
    15  degree.
    16     (b)  Definition.--As used in this section the term "private
    17  residential property" means a building structure containing
    18  habitational accommodations for a total not exceeding four

     1  families, whether or not the structure is occupied in whole or
     2  in part by the owner.
     3     Section 2.  This act shall take effect in 90 days.
