           REPRESENTATIVES, AS AMENDED, OCTOBER 25, 1983

                                     AN ACT

     1  Amending the act of October 15, 1980 (P.L.950, No.164),
     2     entitled, "A supplement to the act of April 9, 1929 (P.L.177,
     3     No.175), entitled 'An act providing for and reorganizing the
     4     conduct of the executive and administrative work of the
     5     Commonwealth by the Executive Department thereof and the
     6     administrative departments, boards, commissions, and officers
     7     thereof, including the boards of trustees of State Normal
     8     Schools, or Teachers Colleges; abolishing, creating,
     9     reorganizing or authorizing the reorganization of certain
    10     administrative departments, boards, and commissions; defining
    11     the powers and duties of the Governor and other executive and
    12     administrative officers, and of the several administrative
    13     departments, boards, commissions, and officers; fixing the
    14     salaries of the Governor, Lieutenant Governor, and certain
    15     other executive and administrative officers; providing for
    16     the appointment of certain administrative officers, and of
    17     all deputies and other assistants and employes in certain
    18     departments, boards, and commissions; and prescribing the
    19     manner in which the number and compensation of the deputies
    20     and all other assistants and employes of certain departments,
    21     boards and commissions shall be determined,' implementing the
    22     addition of section 4.1 to Article IV of the Constitution of
    23     Pennsylvania; establishing the Office of Attorney General
    24     elected by the citizens and setting forth powers and duties
    25     of the Attorney General; creating an Office of General
    26     Counsel and providing for legal services for Commonwealth
    27     agencies; transferring, reorganizing or reconstituting
    28     certain boards, commissions and agencies; placing certain


     1     duties upon the courts and district attorneys; repealing
     2     certain acts and parts of acts and making appropriations,"
     3     requiring the Attorney General to perform all legal services
     4     required for issuance of all State general obligation bonds
     5     or notes or other bonds and notes.

     6      The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 204 of the act of October 15, 1980
     9  (P.L.950, No.164), known as the Commonwealth Attorneys Act, is
    10  amended by adding a subsection to read:
    11  Section 204.  Legal advice and civil matters.
    12     * * *
    13     (g)  Bonds and notes.--
    14         (1)  The Attorney General shall perform any and all legal
    15     services required with respect to the issuance of all general
    16     obligation bonds and notes and all other bonds and notes of
    17     the Commonwealth which are issued by the Commonwealth or any
    18     of its agencies, authorities or, except as provided in
    19     paragraph (3), commissions which legal services shall be
    20     performed by one or more salaried assistant attorneys.
    21         (2)  The Attorney General may, during the initial          <--
    22     implementation of this function, hire, at his discretion,
    23     such outside counsel as the Attorney General deems necessary.
    24     Thereafter the Attorney General may, when such services are
    25     absolutely necessary to protect the public interest, contract
    26     with outside bond counsel for certain services.
    27         (2)  THE ATTORNEY GENERAL MAY, WHEN SUCH SERVICES ARE      <--
    28     NECESSARY TO PROTECT THE PUBLIC INTEREST, CONTRACT WITH
    29     OUTSIDE BOND COUNSEL FOR CERTAIN SERVICES.
    30         (3)  The provisions of paragraphs (1) and (2) shall not
    31     apply to the Pennsylvania Turnpike Commission.
    32     Section 2.  The act is amended by adding a section to read:

     1  Section 501.1.  Specific transfer of certain powers and duties
     2                  to the Attorney General.
     3     The powers and duties of the Department of Community Affairs
     4  as set forth in sections 801, 802, 803, 804, 805, 806, 807, 808,
     5  809 and 810 of the act of July 12, 1972 (P.L.781, No.185), known
     6  as the "Local Government Unit Debt Act," are hereby transferred
     7  to and shall be exercised by the Office of Attorney General.
     8     Section 3.  Article VIII of the act of July 12, 1972
     9  (P.L.781, No.185), known as the Local Government Unit Debt Act,
    10  is repealed insofar as it is inconsistent with the provisions of
    11  section 2 of this amendatory act.
    12     Section 4.  This act shall take effect immediately.
