                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," requiring able-bodied
     4     recipients to assist others in emergencies and disasters.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 405 of the act of June 13, 1967 (P.L.31,
     8  No.21), known as the Public Welfare Code, is amended to read:
     9     Section 405.  Regulations as to Community Work and
    10  Training.--(a)  The department shall establish rules,
    11  regulations and standards, consistent with the Federal Social
    12  Security Act and regulations issued thereunder, for
    13  administration by local boards of community work and training
    14  programs for employable recipients of assistance. The conditions
    15  applicable to work performed by employable recipients of general
    16  assistance shall be the same as those pertaining to recipients
    17  of assistance for which Federal financial participation is
    18  available to the Commonwealth, except that work required to be


     1  performed by recipients of general assistance may be work for a
     2  public or nonprofit private agency. Any agency for which work is
     3  performed under the provisions of this section shall reimburse
     4  the persons performing such work for any additional expenses
     5  reasonably attributable to such work, and for which provisions
     6  are not made in the assistance grant or shall make provision for
     7  meeting the needs for which such expenses would be incurred, to
     8  the same extent and in the same manner that provision for
     9  meeting such expenses or needs is made under rules and
    10  regulations of the department in the case of other adult
    11  assistance recipients who are employed. Such work shall be of a
    12  constructive nature for the conservation of work skills and
    13  development of new skills for individuals who have attained the
    14  age of eighteen, and are receiving aid to families with
    15  dependent children or general assistance under conditions which
    16  are designed to assure protection of the health and welfare of
    17  such individuals and the dependent children involved.
    18     (b)  The department shall, when requested by the State
    19  Council of Civil Defense, provide a list of able-bodied
    20  recipients of assistance from such areas of the Commonwealth as
    21  the council shall request. The department may exclude from the
    22  list those able-bodied recipients who are themselves involved in
    23  the emergency or disaster or who are caring for other persons
    24  not able to care for themselves. All able-bodied recipients
    25  listed shall assist others in emergency or disaster areas as the
    26  Director of Civil Defense shall direct. The Director of Civil
    27  Defense shall coordinate the assignment, transportation and
    28  supervision of the recipients. All departments and agencies of
    29  the State government and all municipalities and school districts
    30  of the Commonwealth shall cooperate with the Director of Civil

     1  Defense in transportation, providing food, shelter, appropriate
     2  clothing and equipment and supervising the duties assigned to
     3  the recipients. Any able-bodied recipient who fails to perform
     4  his or her assignment shall not be eligible for assistance
     5  payments for a period equal to the time other recipients are
     6  assigned to emergency or disaster relief work.
     7     Section 2.  All acts and parts of acts are repealed insofar
     8  as they are inconsistent with this act.
     9     Section 3.  This act shall take effect in 60 days.
