                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for the minimum
     6     number of days.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1501 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended June 30, 1980 (P.L.279, No.80), is amended to read:
    12     Section 1501.  Minimum Number of Days; School Month.--All
    13  public kindergartens, elementary and secondary schools shall be
    14  kept open each school year for at least one hundred eighty (180)
    15  days of instruction for pupils. No days on which the schools are
    16  closed shall be counted as days taught, and no time shall be
    17  counted as a pupil session for any activity to which admission
    18  is charged. No school district shall be required to change its
    19  graduation schedule or require graduating students to return to


     1  school after graduation to make up class days lost due to severe
     2  weather conditions or, in the school year 1979-1980 for
     3  situations beyond the control of the school district as a result
     4  of major construction and renovation to the school building. No
     5  district which makes a bona fide effort as determined by the
     6  Secretary of Education to provide one hundred eighty (180) days
     7  of instruction for graduating students shall receive less
     8  subsidy payments or reimbursements than it would otherwise be
     9  entitled to receive on account of the school year because of the
    10  provisions of this section. Unless otherwise provided by this
    11  act, the board of school directors in any district or joint
    12  board may keep such other schools or departments as it may
    13  establish open during such time as it may direct. In the event
    14  it appears that any school district will not be able to keep
    15  schools open in any school year for a minimum of one hundred
    16  eighty (180) days of instruction for pupils as a result of a
    17  work stoppage, the Secretary of Education shall petition the
    18  court of common pleas wherein jurisdiction lies to ensure an
    19  order to terminate the work stoppage and the Secretary of
    20  Education shall utilize whatever means necessary to assist the
    21  school district in providing the one hundred eighty (180) days
    22  of instruction for the pupils in accordance with the officially
    23  adopted calendar of instructional days approved by the board of
    24  school directors.
    25     Twenty days of actual teaching shall constitute a school
    26  month.
    27     Section 2.  This act shall take effect in 60 days.
