AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, prohibiting certain sun screening devices on 3 windshields and windows of motor vehicles; AND PROVIDING AN <-- 4 EXCEPTION. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 4524 of Title 75 of the Pennsylvania 8 Consolidated Statutes is amended to read: 9 § 4524. Windshield obstructions and wipers. 10 (a) Obstruction on front windshield.--No person shall drive 11 any motor vehicle with any sign, poster or other nontransparent 12 material upon the front windshield which materially obstructs, 13 obscures or impairs the driver's clear view of the highway or 14 any intersecting highway except an inspection certificate, 15 sticker identification sign on a mass transit vehicle or other 16 officially required sticker and no person shall drive any motor 17 vehicle with any ice or snow on the front windshield which
1 materially obstructs, obscures or impairs the driver's clear 2 view of the highway or any intersecting highway. 3 (b) Obstruction on side and rear windows.--No person shall 4 drive any motor vehicle with any sign, poster or other 5 nontransparent material, including ice or snow, upon the side 6 wings or side or rear windows of the vehicle which materially 7 obstructs, obscures or impairs the driver's clear view of the 8 highway or any intersecting highway. 9 (c) Other obstruction.--No person shall drive any motor 10 vehicle with any object or material hung from the inside 11 rearview mirror or otherwise hung, placed or attached in such a 12 position as to materially obstruct, obscure or impair the 13 driver's vision through the front windshield or any manner as to 14 constitute a safety hazard. 15 (d) Windshield wiper systems.--The windshield on every motor 16 vehicle other than a motorcycle or special mobile equipment 17 shall be equipped with a wiper system capable of cleaning rain, 18 snow or other moisture from the windshield, and so constructed 19 as to be controlled or operated by the driver of the vehicle. 20 (e) Sun screening and other materials prohibited.-- 21 (1) No person shall drive any motor vehicle with any sun 22 screening device or other material which does not permit a 23 person to see or view the inside of the vehicle through the 24 windshield, side wing, side window or rear window of the 25 vehicle. The only exceptions to this subsection are tinted <-- 26 windows of the type and specification which are installed by 27 vehicle manufacturers. 28 (2) This subsection shall not apply to motor vehicles 29 which have been equipped by the manufacturer with sun 30 screening or other materials prior to the effective date of 19830H1244B2391 - 2 -
1 this subsection. 2 (2) THIS SUBSECTION DOES NOT APPLY TO ANY VEHICLE WHICH <-- 3 IS EQUIPPED WITH TINTED WINDOWS OF THE TYPE AND SPECIFICATION 4 THAT WERE INSTALLED BY THE MANUFACTURER OF THE VEHICLE OR TO 5 ANY VEHICLE TO WHICH A CURRENTLY VALID CERTIFICATE OF 6 EXEMPTION IS AFFIXED AS SPECIFIED BY REGULATION ADOPTED BY 7 THE DEPARTMENT. A CERTIFICATE OF EXEMPTION SHALL BE ISSUED BY 8 THE DEPARTMENT FOR A VEHICLE WHICH IS REGISTERED IN THIS 9 COMMONWEALTH ON THE EFFECTIVE DATE OF THIS SUBSECTION INSOFAR 10 AS THE VEHICLE IS EQUIPPED WITH A SUN SCREENING DEVICE OR 11 OTHER MATERIAL PROHIBITED UNDER PARAGRAPH (1) ON THE 12 EFFECTIVE DATE. 13 SECTION 2. SECTION 4706(G) OF TITLE 75 IS AMENDED TO READ: 14 § 4706. PROHIBITION ON EXPENDITURES FOR EMISSION INSPECTION 15 PROGRAM. 16 * * * 17 (G) REGULATIONS.--THE DEPARTMENT SHALL ESTABLISH AND 18 PROMULGATE SUCH REGULATIONS AS MAY BE NECESSARY TO IMPLEMENT 19 THIS SECTION BUT IT SHALL NOT PROMULGATE A REGULATION THAT WOULD 20 REQUIRE SAFETY INSPECTION STATIONS TO ALSO PERFORM EMISSION 21 CONTROL INSPECTIONS. THE DEPARTMENT SHALL NOT ESTABLISH A 22 REGULATION WHICH IMPOSES A MORE STRICT STANDARD THAN THE MINIMUM 23 STANDARDS REQUIRED BY THE FEDERAL ENVIRONMENTAL PROTECTION 24 AGENCY UNDER THE FEDERAL CLEAN AIR ACT. 25 * * * 26 Section 2 3.
