                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," providing
     4     for removal of trees; and further providing for payment by
     5     owners.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 1202(63) and 2727 of the act of February
     9  1, 1966 (1965 P.L.1656, No.581), known as The Borough Code, are
    10  amended to read:
    11     Section 1202.  Specific Powers.--The powers of the borough
    12  shall be vested in the corporate authorities. Among the specific
    13  powers of the borough shall be the following, and in the
    14  exercise of any of such powers involving the enactment of any
    15  ordinance or the making of any regulation, restriction or
    16  prohibition, the borough may provide for the enforcement thereof
    17  and may prescribe penalties for the violation thereof or for the
    18  failure to conform thereto:

     1     (63)  Purchase [and], planting or removal of trees. To
     2  accept, purchase [and], plant, remove or contribute to the
     3  purchasing [and], planting or removal of shade trees along the
     4  streets and sidewalks of the borough.
     5     * * *
     6     Section 2727.  Payment by Owners.--The cost of planting,
     7  transplanting, or removing any shade trees in and along the
     8  streets and highways in the borough, of the necessary and
     9  suitable guards, curbing or grading for the protection thereof,
    10  and of the replacing of any pavement or sidewalk necessarily
    11  disturbed in the execution of such work, shall be paid, at the
    12  option of the borough, by the owner of the real estate abutting
    13  which the work is done or by the borough.
    14     The amount each owner is to pay shall be ascertained and
    15  certified by the commission to council and to the borough
    16  treasurer.
    17     Section 2.  This act shall take effect in 60 days.
