A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations to Pennsylvania State 5 University; providing for a basis for payments of the 6 appropriations; and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. The following sums, or as much thereof as may be 11 necessary, are hereby appropriated to the Trustees of 12 Pennsylvania State University, for the fiscal year July 1, 1983 13 to June 30, 1984, for the following purposes and amounts: 14 (1) For educational and general expenses..... $109,041,000 15 (2) For cost of student aid.................. 1,760,000 16 (3) For cost of research..................... 9,932,000 17 (4) For instruction - Doctor of Medicine only 3,160,000 18 (5) For cost of agricultural research........ 11,820,000 19 (6) For cost of agricultural extension 20 services................................. 10,002,000
1 (7) For cost of operating Elizabethtown 2 Hospital................................. 3,328,000 3 (8) For cost of soil survey.................. 100,000 4 (9) To enhance the recruitment and 5 retention of disadvantaged students...... 200,000 6 (10) For the purchase of services 7 from the Buhl-Henderson Community 8 Library of Sharon, Pennsylvania.......... 25,000 9 Section 2. Payments to Pennsylvania State University on 10 account of the appropriations provided in section 1 shall be 11 made on the basis of costs during the fiscal year. 12 Section 3. If necessary, Pennsylvania State University may 13 transfer funds among the appropriations listed in section 1(1), 14 (2), (3), (5) and (6). The aggregate amount transferred into or 15 out of each appropriation during the fiscal year shall not 16 exceed 5% of the amount specifically appropriated for that 17 purpose. 18 Section 4. (a) Payments to Pennsylvania State University of 19 the appropriations provided in section 1 shall be made monthly 20 during the fiscal year. 21 (b) The monthly payments shall be made in accordance with 22 section 2 on the basis of estimated costs. The estimate of costs 23 shall be submitted by the Pennsylvania State University to the 24 Secretary of Education, the General Assembly and the State 25 Treasurer not later than 30 days prior to the date on which the 26 payment is to be made. 27 Section 5. Notwithstanding any provision of the General 28 Appropriation Act of 1983 relating to the payment of retirement 29 expenses, the Trustees of Pennsylvania State University shall 30 make all required payments to the State Employees' Retirement 19830H1023B1510 - 2 -
1 Fund from the funds appropriated pursuant to this act. 2 Section 6. (a) Pennsylvania State University shall apply 3 the moneys appropriated by this act only for the purposes 4 permitted in this act and shall at all times maintain proper 5 records showing the application of the moneys. Not later than 6 120 days after the close of the fiscal year to which this act 7 relates, Pennsylvania State University shall file with the 8 Secretary of Education, the General Assembly and the Auditor 9 General a statement setting forth the amounts and purposes of 10 all expenditures made from moneys appropriated by this act and 11 other university accounts during the fiscal year, as provided in 12 section 2, used as a basis for receipt of any appropriation 13 during the fiscal year. 14 (b) The statement of expenditures and costs shall be 15 reviewed by the Auditor General who has the right, in respect to 16 the moneys appropriated by this act, to audit and disallow 17 expenditures made for purposes not permitted by this act and to 18 cause such sums to be recovered and paid by Pennsylvania State 19 University to the State Treasurer. In respect to expenditures 20 made by the university from moneys other than those appropriated 21 by this act, the Auditor General has the right to review only 22 and shall file annually with the General Assembly any 23 information concerning these expenditures as the General 24 Assembly or any of its committees may require. 25 Section 7. A report shall be submitted to the Governor and 26 the Appropriations and Education Committees of the Senate and 27 House of Representatives and shall include data for all programs 28 except the Doctor of Medicine program. The report, to be 29 submitted prior to September 1, 1984, shall cover the 12-month 30 period beginning with the summer term 1983 and shall include: 19830H1023B1510 - 3 -
1 (1) The following counts and distributions for each term 2 during the period: 3 (i) The definitions and numbers of faculty members employed 4 full-time, of faculty members employed part-time, of full-time 5 students enrolled in graduate courses, of full-time students 6 enrolled in undergraduate courses, of part-time students 7 enrolled in graduate courses and of part-time students enrolled 8 in undergraduate courses. 9 (ii) The total numbers of undergraduate student credit 10 hours, divided into lower division and upper division course 11 levels and of graduate student credit hours divided into three 12 course levels: master's, first professional and doctoral. 13 (iii) The number of different courses scheduled by level of 14 instruction and the number of sections of individual instruction 15 at each level of instruction. 16 (iv) The number of terms scheduled and the dates thereof. 17 (2) For the summer term and the following academic year in 18 total and for each two-digit Hegis category of instructional 19 programs in higher education as defined by the National Center 20 for Education Statistics, United States Department of Education, 21 a classification of faculty members or other professional 22 employees by title including: professor, associate professor, 23 assistant professor, instructor, lecturer, research associate, 24 librarian and academic administrator; faculty members or other 25 professional employees under each title to be subdivided by type 26 of assignment: teaching and nonteaching, with each set of 27 faculty members or other professional employees to be further 28 subdivided by type of employment: full-time or part-time and the 29 following aggregates for each subdivided classification: 30 (i) The number of faculty and other professional employees 19830H1023B1510 - 4 -
1 and their full-time equivalence in instructional and 2 noninstructional functions. 3 (ii) The sum of credits assigned to undergraduate classroom 4 courses and the sum of credits assigned to graduate classroom 5 courses taught, divided into lower division, upper division, 6 master's, first professional and doctoral course levels. 7 (iii) The sum of credits assigned to undergraduate 8 individual instruction courses and the sum of credits assigned 9 to graduate individual instruction courses taught, divided into 10 lower division, upper division, master's, first professional and 11 doctoral course levels. 12 (iv) The sum of undergraduate classroom student credit hours 13 and the sum of graduate classroom student credit hours 14 generated; divided into lower division, upper division, 15 master's, first professional and doctoral course levels. 16 (v) The sum of undergraduate individual instruction student 17 credit hours and the sum of graduate individual instruction 18 student credit hours generated; divided into lower division, 19 upper division, master's, first professional and doctoral course 20 levels. 21 (vi) The total salary paid for instructional functions and 22 for noninstructional functions and the amount of this salary 23 paid for each of these functions from college or university 24 funds, Federal funds and other funds. 25 (3) For each term of the period covered for each faculty 26 member employed full-time identified by two-digit Hegis category 27 and title, the report shall contain an analysis of the average 28 hours per week spent in college or university-related 29 activities, stating specifically hours spent in undergraduate 30 classroom contact and graduate classroom contact, hours spent in 19830H1023B1510 - 5 -
1 preparation, hours spent in research and hours spent in public 2 service. 3 Section 8. (a) In addition to the requirements in section 7 4 relative to this appropriation, the report covering the 12-month 5 period beginning with the summer term 1983 shall include for all 6 programs of the university: 7 (1) The minimum number of credits required for a 8 baccalaureate degree and for a master's degree. 9 (2) The number of bachelor's degrees, master's degrees, 10 first professional degrees and doctoral degrees awarded in 1981, 11 1982, 1983 and estimated 1984. 12 (b) Pennsylvania State University shall report its revenues 13 and expenditures and present its financial statements required 14 under the provisions of this act in accordance with the "Higher 15 Education Finance Manual of 1975." 16 Section 9. An additional report shall be submitted to the 17 Governor and the Appropriations and Education Committees of the 18 Senate and House of Representatives and shall include data which 19 indicates the increase in recruitment and retention activities 20 of the Pennsylvania State University relating to minority <-- 21 DISADVANTAGED students and faculty and the extent to which such <-- 22 activities have increased or will increase minority <-- 23 DISADVANTAGED student enrollment and minority faculty <-- 24 participation. 25 Section 10. Pennsylvania State University shall provide such 26 information as may be necessary to carry out the provisions of 27 this act and in the form and manner as the Department of 28 Education may prescribe. 29 Section 11. Pennsylvania State University shall report its 30 revenues and expenditures and present its financial statements 19830H1023B1510 - 6 -
1 required under the provisions of this act in accordance with 2 generally accepted accounting principles and procedures for 3 educational institutions as set forth in the "Higher Education 4 Finance Manual of 1975," with the exceptions set forth in the 5 "Commonwealth of Pennsylvania Budget Instructions for State 6 Related Universities, Phase I, Fiscal Year 1983-1984." Credits 7 granted for nontraditional programs such as CLEP, lifelong 8 learning etc., including all related costs and revenues thereof 9 shall be excluded from the function of "Instruction" and 10 included under "Public Service." 11 Section 12.
