                                     AN ACT

     1  Amending the act of June 24, 1968 (P.L.237, No.111), entitled
     2     "An act specifically authorizing collective bargaining
     3     between policemen and firemen and their public employers;
     4     providing for arbitration in order to settle disputes, and
     5     requiring compliance with collective bargaining agreements
     6     and findings of arbitrators," further providing for the
     7     selection and compensation of the third arbitrator.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Sections 4(b) and 8 of the act of June 24, 1968
    11  (P.L.237, No.111), referred to as the Policemen and Firemen
    12  Collective Bargaining Act, are amended to read:
    13     Section 4.  * * *
    14     (b)  The board of arbitration shall be composed of three
    15  persons, one appointed by the public employer, one appointed by
    16  the body of policemen or firemen involved, and a third member to
    17  be agreed upon by the public employer and such policemen or
    18  firemen. When a political subdivision of the Commonwealth is the
    19  public employer, the third member of the board of arbitration,
    20  wherever possible, shall be a resident of the employing

     1  political subdivision. If no resident of the employing political
     2  subdivision is available, a resident of another political
     3  subdivision within the county in which the employing political
     4  subdivision is located shall be chosen. If a county resident is
     5  not available either, a written explanation for the
     6  unavailability of a resident of the political subdivision or the
     7  county shall be made by the parties at the time the third
     8  arbitrator is selected. The members of the board representing
     9  the public employer and the policemen or firemen shall be named
    10  within five days from the date of the request for the
    11  appointment of such board. If, after a period of ten days from
    12  the date of the appointment of the two arbitrators appointed by
    13  the public employer and by the policemen or firemen, the third
    14  arbitrator has not been selected by them, then either arbitrator
    15  may request the American Arbitration Association, or its
    16  successor in function, to furnish a list of three members of
    17  said association who are residents of Pennsylvania, and if
    18  possible, residents of the employing political subdivision or
    19  county, as herein provided, from which the third arbitrator
    20  shall be selected. If no residents of employing subdivision or
    21  county are available, a written explanation for their
    22  unavailability shall be provided by the American Arbitration
    23  Association. The arbitrator appointed by the public employer
    24  shall eliminate one name from the list within five days after
    25  publication of the list, following which the arbitrator
    26  appointed by the policemen or firemen shall eliminate one name
    27  from the list within five days thereafter. The individual whose
    28  name remains on the list shall be the third arbitrator and shall
    29  act as chairman of the board of arbitration. The board of
    30  arbitration thus established shall commence the arbitration

     1  proceedings within ten days after the third arbitrator is
     2  selected and shall make its determination within thirty days
     3  after the appointment of the third arbitrator.
     4     Section 8.  The compensation, if any, of the arbitrator
     5  appointed by the policemen or firemen shall be paid by them. The
     6  compensation of the [other two arbitrators,] arbitrator
     7  appointed by the political subdivision or by the Commonwealth
     8  shall be paid by the employing subdivision or by the
     9  Commonwealth, as the case may be. The compensation of the third
    10  arbitrator, as well as all stenographic and other expenses
    11  incurred by the arbitration panel in connection with the
    12  arbitration proceedings, shall be paid equally by the political
    13  subdivision or by the Commonwealth, as the case may be, and by
    14  the policemen or firemen.
    15     Section 2.  This act shall take effect in 60 days.
