                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for members of the
     3     commission.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 301(a) and (e) of Title 66 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 301.  Establishment, members, qualifications and chairman.
     9     (a)  Appointment and terms of members.--The Pennsylvania
    10  Public Utility Commission, established by the act of March 31,
    11  1937 (P.L.160, No.43), as an independent administrative
    12  commission, is hereby continued as such and shall consist of
    13  five members who shall be appointed by the Governor, by and with
    14  the advice and consent of [two-thirds] a majority of all the
    15  members of the Senate, for a term of [ten] five years. No
    16  commissioner upon the expiration of his term shall continue to
    17  hold office until his successor shall be duly appointed or shall
    18  be qualified. No more than three members shall be of the same

     1  political party.

     3     (e)  Compensation.--Each of the commissioners shall receive
     4  an annual salary of [$35,000, as of January 1, 1977, and
     5  $40,000, as of January 1, 1978] $50,000, except the chairman,
     6  who shall receive an annual salary of [$37,500, as of January 1,
     7  1977, and $42,500, as of January 1, 1978.] $55,000. Each of the
     8  commissioners shall, in addition, be given a 5% cost-of-living
     9  increase each year.

    11     Section 2.  (a)  The terms of existing members of the
    12  commission shall expire on December 31, 1983.
    13     (b)  Initial appointments for terms commencing January 1,
    14  1984 shall be as follows:
    15         (1)  One member for a term of one year.
    16         (2)  One member for a term of two years.
    17         (3)  One member for a term of three years.
    18         (4)  One member for a term of four years.
    19         (5)  One member for a term of five years.
    20     Section 3.  Notwithstanding section 4, the Governor may
    21  proceed to nominate commission members for the terms commencing
    22  January 1, 1984. Confirmation shall require only a majority of
    23  all the members of the Senate.
    24     Section 4.  This act shall take effect January 1, 1984.
