AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for the burden of proof in
3 certain vehicle registration violations.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1301 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 1301. Driving unregistered vehicle prohibited.
9 (a) General rule.--It is a summary offense for any person to
10 drive or for an owner knowingly to permit to be driven upon any
11 highway any vehicle of a type required to be registered under
12 this chapter which is not registered or for which the
13 appropriate fee has not been paid when and as required in this
14 title.
15 (b) Burden of proof.--Any person charged with a violation of
16 this section who uses a defense based on section 1303 (relating
17 to vehicles of nonresidents exempt from registration) shall have
18 the burden of proving the status of nonresident. Any person who
1 presents satisfactory proof of nonresidence at the office of the
2 issuing authority within five days of the issuance of a citation
3 shall be entitled to have the citation dismissed. For the
4 purposes of this subsection, satisfactory proof includes, but is
5 not limited to, Federal, State or local personal or corporate
6 income tax returns.
7 Section 2. This act shall take effect in 60 days.
