                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for the furnishing
     3     of services at a just and reasonable rate.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1301 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1301.  Rates to be just and reasonable.
     9     Every rate made, demanded, or received by any public utility,
    10  or by any two or more public utilities jointly, shall be just
    11  and reasonable, and in conformity with regulations or orders of
    12  the commission. The price allowed to be paid pursuant to Federal
    13  legislation or any regulation by any agency implementing the
    14  legislation, or the price paid or to be paid for any sale of
    15  natural gas or electricity, shall not be taken into account in
    16  applying any indefinite price escalator clause or any clause
    17  requiring a minimum payment or take or pay regardless of receipt
    18  or purchase clauses contained in any purchase contract applying

     1  to the sale of natural gas. The price collected for the first
     2  sale of natural gas or any subsequent sale of natural gas shall
     3  be permitted only to the extent necessary to recover any
     4  production fees, taxes and a reasonable return attributable to
     5  the natural gas or electricity. Only public utility service
     6  being furnished or rendered by a municipal corporation, or by
     7  the operating agencies of any municipal corporation, beyond its
     8  corporate limits, shall be subject to regulation and control by
     9  the commission as to rates, with the same force, and in like
    10  manner, as if such service were rendered by a public utility.
    11     Section 2.  This act shall apply to all natural gas delivered
    12  to a purchaser on or after the effective date of this act.
    13     Section 3.  This act shall take effect immediately.
