                                     AN ACT

     1  Amending the act of August 31, 1971 (P.L.398, No.96), entitled
     2     "An act providing for the creation, maintenance and operation
     3     of a county employes' retirement system, and imposing certain
     4     charges on counties and providing penalties," further
     5     providing for the county retirement board.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4 of the act of August 31, 1971 (P.L.398,
     9  No.96), known as the County Pension Law, is amended to read:
    10     Section 4.  County Retirement System; County Retirement
    11  Board.--(a)  A retirement system may be established for county
    12  employes by resolution of the county commissioners in any county
    13  of the second class A, third class, fourth class, fifth class,
    14  sixth class, seventh class and eighth class. The retirement
    15  system shall be established on the first Monday of January of
    16  the year succeeding the one in which the resolution of the
    17  county commissioners was adopted.
    18     (b)  The system, when established, shall be administered by a
    19  county retirement board, consisting of [five] six members, three

     1  of whom shall be the county commissioners, the county controller
     2  [and], the county treasurer and a retired employe representative
     3  to be chosen by the retired county employes. In counties having
     4  no elected county controller, the chief clerk of the county
     5  shall be a member of the board. The chairman of the board of
     6  county commissioners shall be chairman of the board. Each member
     7  of the board shall take an oath of office that he will
     8  diligently and honestly administer the affairs of the board, and
     9  that he will not knowingly violate or permit to be violated any
    10  of the provisions of this act. Such oath shall be subscribed by
    11  the member taking it, and shall be filed among the records of
    12  the board. The members of the board shall not receive any
    13  compensation for their services, but shall be reimbursed for all
    14  expenses necessarily incurred in the performance of their duty.
    15  [Three] Four members of the board shall constitute a quorum.
    16     Section 2.  This act shall take effect in 60 days.
