                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.343, No.176), entitled
     2     "An act relating to the finances of the State government;
     3     providing for the settlement, assessment, collection, and
     4     lien of taxes, bonus, and all other accounts due the
     5     Commonwealth, the collection and recovery of fees and other
     6     money or property due or belonging to the Commonwealth, or
     7     any agency thereof, including escheated property and the
     8     proceeds of its sale, the custody and disbursement or other
     9     disposition of funds and securities belonging to or in the
    10     possession of the Commonwealth, and the settlement of claims
    11     against the Commonwealth, the resettlement of accounts and
    12     appeals to the courts, refunds of moneys erroneously paid to
    13     the Commonwealth, auditing the accounts of the Commonwealth
    14     and all agencies thereof, of all public officers collecting
    15     moneys payable to the Commonwealth, or any agency thereof,
    16     and all receipts of appropriations from the Commonwealth and
    17     imposing penalties; affecting every department, board,
    18     commission, and officer of the State government, every
    19     political subdivision of the State, and certain officers of
    20     such subdivisions, every person, association, and corporation
    21     required to pay, assess, or collect taxes, or to make returns
    22     or reports under the laws imposing taxes for State purposes,
    23     or to pay license fees or other moneys to the Commonwealth,
    24     or any agency thereof, every State depository and every
    25     debtor or creditor of the Commonwealth," further providing
    26     for the deposit and disbursement of certain funds.

    27     The General Assembly of the Commonwealth of Pennsylvania
    28  hereby enacts as follows:
    29     Section 1.  Section 1301.18 of the act of April 9, 1929


     1  (P.L.343, No.176), known as The Fiscal Code, added December 9,
     2  1982 (P.L.1057, No.248), is amended to read:
     3     Section 1301.18.  Deposit and Disbursement of Funds.--(a)
     4  [All] Subject to the provisions of subsection (c), all funds
     5  received under this article, including the proceeds from the
     6  sale of property under section 1301.17, shall forthwith be
     7  deposited by the secretary in the General Fund of the
     8  Commonwealth, except that the secretary shall retain in a
     9  separate trust fund an amount not exceeding twenty-five thousand
    10  dollars ($25,000) plus twenty per centum of deposits and sums
    11  paid to the secretary under subsection (c) of section 1301.13
    12  during the preceding twelve (12) months from which he shall make
    13  reimbursements under section 1301.14 and prompt payment of
    14  claims duly allowed under section 1301.19. Before making the
    15  deposit he shall record the name and last known address of each
    16  person appearing from the holders' reports to be entitled to the
    17  property and of the name and last known address of each insured
    18  person or annuitant, and with respect to each policy or contract
    19  listed in the report of an insurer, its number, the name of the
    20  insurer and the amount due. The record with respect to any
    21  specific claim shall be available to the claimant at all regular
    22  business hours.
    23     (b)  Before making any deposit to the credit of the General
    24  Fund, the secretary may deduct:
    25     (i)  Reasonable costs in connection with sale of the
    26  property,
    27     (ii)  Reasonable costs of mailing and publication in
    28  connection with any property, and
    29     (iii)  Reasonable service charges.
    30     (c)  The following provisions shall apply to all funds

     1  received from utilities subject to regulation and control by the
     2  Public Utility Commission:
     3     1.  The funds shall be held in trust solely for the purpose
     4  of providing additional funds for the Commonwealth's State Plan
     5  for the Low-Income Home Energy Assistance Program, shall be
     6  earmarked for use by the Department of Public Welfare in making
     7  payments pursuant to the plan for the Low-Income Home Energy
     8  Assistance Program and are hereby appropriated to the Department
     9  of Public Welfare for disbursement solely for that purpose.
    10     2.  Disbursement of the funds by the Department of Public
    11  Welfare shall be made to appropriate local agencies. The amount
    12  of funds to be disbursed to the local agency of a county shall
    13  be determined by ascertaining the amount of funds received from
    14  each utility subject to regulation and control by the Public
    15  Utility Commission and then multiplying the amount so determined
    16  by a fraction, the numerator of which shall be the number of
    17  residential customers served by the utility in the county and
    18  the denominator of which shall be the total number of
    19  residential customers served by the utility.
    20     Section 2.  This act shall take effect July 1, 1983.
