AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," further providing for certain
6 construction and repairs and the letting of certain
7 contracts. by school districts of the first class. <--
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 751(B) of the act of March 10, 1949 <--
11 (P.L.30, No.14), known as the Public School Code of 1949, is <--
12 amended by adding a subsection AMENDED FEBRUARY 4, 1982 (P.L.1, <--
13 NO.1), IS AMENDED AND A SUBSECTION IS ADDED to read:
14 Section 751. Work to be Done Under Contract Let on Bids;
15 Exception.--* * *
16 (B) THE BOARD OF SCHOOL DIRECTORS IN ANY SCHOOL DISTRICT <--
17 EITHER MAY PERFORM ANY CONSTRUCTION, RECONSTRUCTION, REPAIRS, OR
18 WORK OF ANY NATURE, WHERE THE ENTIRE COST OR VALUE, INCLUDING
19 LABOR AND MATERIAL, IS LESS THAN [FIVE THOUSAND DOLLARS ($5000)]
1 TEN THOUSAND DOLLARS ($10,000), BY ITS OWN MAINTENANCE
2 PERSONNEL, OR MAY HAVE ANY SUCH CONSTRUCTION, RECONSTRUCTION,
3 REPAIRS, OR WORK PERFORMED BY CONTRACT AFTER SOLICITING BIDS
4 FROM AT LEAST THREE RESPONSIBLE BIDDERS: PROVIDED, THAT THE
5 BOARD OF SCHOOL DIRECTORS IN ANY SCHOOL DISTRICT MAY AUTHORIZE
6 THE SECRETARY OF THE BOARD OR OTHER EXECUTIVE TO AWARD CONTRACTS
7 FOR CONSTRUCTION, RECONSTRUCTION, REPAIRS, OR WORK OF ANY
8 NATURE, WHERE THE ENTIRE COST OR VALUE, INCLUDING LABOR AND
9 MATERIAL, IS FOUR THOUSAND DOLLARS ($4,000) OR LESS, WITHOUT
10 SOLICITING COMPETITIVE BIDS.
11 (b.1) The board of school directors in any school district
12 of the first class either may perform any construction,
13 reconstruction, repairs or work of any nature, where the entire
14 cost or value, including labor and material, is less than fifty
15 thousand dollars ($50,000), by its own maintenance personnel, or
16 may have any such construction, reconstruction, repairs, or work
17 NOT EXCEEDING TEN THOUSAND DOLLARS ($10,000) performed by <--
18 contract after soliciting bids from at least three responsible
19 bidders: Provided, That the board of school directors in any
20 school district of the first class may authorize the secretary
21 of the board or other executive to award contracts for
22 construction, reconstruction, repairs, or work of any nature,
23 where the entire cost or value, including labor and material, is
24 four thousand dollars ($4,000) or less, without soliciting
25 competitive bids.

27 Section 2. This act shall take effect in 60 days.
