           REPRESENTATIVES, AS AMENDED, APRIL 25, 1983

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for manner of
     6     election or approval of school directors.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1073(b) of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended January 16, 1974 (P.L.1, No.1), is amended to read:
    12     Section 1073.  Manner of Election or Approval.--* * *
    13     (b)  At a regular meeting of the board of school directors
    14  occurring at least one hundred fifty (150) days prior to the
    15  expiration date of the term of office of the district
    16  superintendent, the agenda shall include an item requiring
    17  affirmative action by five or more members of the board of
    18  school directors to notify the district superintendent that the
    19  board intends to retain him for a further term of from three (3)

     1  to five (5) years or that another or other candidates will be
     2  considered for the office. Upon notification that another
     3  candidate or candidates will be considered, the district
     4  superintendent may request AND SHALL BE GRANTED a meeting in      <--
     5  executive session with the board of school directors to review
     6  the reasons of the board of school directors for reaching its
     7  decision. In the event that the board fails to take such action
     8  at a regular meeting of the board of school directors occurring
     9  at least one hundred fifty (150) days prior to the expiration
    10  date of the term of office of the district superintendent, he
    11  shall continue in office for a further term of similar length to
    12  that which he is serving.

    14     Section 2.  This act shall take effect in 60 days.
