                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, increasing certain fees.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Sections 2701, 2702, 2704 and 2711(b) of Title 30
     6  of the Pennsylvania Consolidated Statutes are amended to read:
     7  § 2701.  Resident fishing licenses.
     8     (a)  General rule.--For the purposes of this chapter any
     9  person 16 years of age or older is entitled to a "Resident
    10  Fishing License" if:
    11         (1)  He has applied to an issuing agent within this
    12     Commonwealth or to the commission.
    13         (2)  He has established his identity, age and the fact
    14     that he is a bona fide resident of this Commonwealth to the
    15     satisfaction of the issuing agent or the commission by
    16     producing a motor vehicle driver's license or some other
    17     positive means of identification.

     1         (3)  He has paid the issuing agent or the commission a
     2     license fee of $12 plus a service fee of [25¢] 50¢ to the
     3     issuing agent.
     4     (b)  Senior citizens.--A person 65 years of age or older at
     5  the time of application who complies with subsection (a)(1) and
     6  (2) is entitled to a "Senior Resident Fishing License" if he
     7  pays a license fee of $2 to the issuing agent or the commission
     8  plus a service fee of [25¢] 50¢ to the issuing agent. The
     9  application shall give the date of birth of the applicant. Any
    10  person who qualifies to purchase a Senior Resident Fishing
    11  License may, in lieu thereof, purchase a Senior Resident Fishing
    12  License which shall be valid for his lifetime upon the payment
    13  of a fee of $10 for the use of the Commonwealth and, in the
    14  event the license is issued by an issuing agent, a fee of [25¢]
    15  50¢ for the use of the issuing agent.
    16  § 2702.  Nonresident and tourist licenses.
    17     (a)  Nonresident licenses.--For the purposes of this chapter
    18  any person 16 years of age or older is entitled to a
    19  "Nonresident Fishing License" if:
    20         (1)  He is not a bona fide resident of this Commonwealth.
    21         (2)  He has applied to an issuing agent or to the
    22     commission.
    23         (3)  He has paid the issuing agent or the commission a
    24     license fee of $20 plus a service fee of [25¢] 50¢ to the
    25     issuing agent.
    26     (b)  Tourist licenses.--For the purposes of this chapter any
    27  person 16 years of age or older is entitled to a "Seven Day
    28  Tourist Fishing License," valid for a period of seven
    29  consecutive days, if:
    30         (1)  He is not a bona fide resident of this Commonwealth.

     1         (2)  He has applied to an issuing agent or to the
     2     commission.
     3         (3)  He has paid the issuing agent or the commission a
     4     license fee of $15 plus a service charge of [25¢] 50¢ to the
     5     issuing agent.
     6  § 2704.  Lost fishing licenses.
     7     In case a license certificate is lost or destroyed, a new
     8  license may be secured from the commission or any issuing agent
     9  upon making affidavit to that effect and paying a fee of $1 plus
    10  a service fee of [25¢] 50¢ to the issuing agent.
    11  § 2711.  Issuing agents.
    12     * * *
    13     (b)  Compensation and fees.--For services rendered in
    14  collecting and paying over license fees, issuing agents, as long
    15  as they continue to act in that capacity, may collect and retain
    16  the sum of [25¢] 50¢ for each fishing license sold which amount
    17  shall be full compensation for services rendered by them under
    18  the provisions of this title. The compensation shall be retained
    19  by the respective issuing agents and shall cover, among other
    20  things, the cost of issuing licenses, postage, mailing, returns
    21  and bonding of said agents. All license fees paid to an issuing
    22  agent under this title shall be paid by those agents into the
    23  State Treasury through the commission at least once a month and
    24  they shall be applied to the purposes provided for in this
    25  title. An issuing agent shall make a return to the commission
    26  upon a form to be supplied by the commission. Any issuing agent
    27  failing to comply with any of the provisions of this section
    28  shall not be entitled to retain the fee fixed in this subsection
    29  for his services but shall pay those fees to the State
    30  Treasurer. If those sums are not so paid, the Commonwealth may

     1  recover them by suit in the same manner as like amounts are now
     2  recoverable by law.

     4     Section 2.  This act shall take effect in 60 days. JANUARY 1,  <--
