AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; and prescribing the manner in which the
18 number and compensation of the deputies and all other
19 assistants and employes of certain departments, boards and
20 commissions shall be determined," authorizing the
21 construction of toll roads and bridges.
22 The General Assembly of the Commonwealth of Pennsylvania
23 hereby enacts as follows:
24 Section 1. Section 2008 of the act of April 9, 1929
25 (P.L.177, No.175), known as The Administrative Code of 1929,
26 amended May 6, 1970 (P.L.356, No.120), is amended to read:
27 Section 2008. Toll Roads and Bridges.--(a) The Department
1 of Transportation shall have the power to acquire, for and on 2 behalf of the Commonwealth, by purchase or otherwise, turnpike 3 or toll roads, or any parts thereof, or toll bridges, in such 4 manner and under and subject to such terms and conditions as may 5 now or hereafter be provided by law. 6 (b) The Department of Transportation shall have the power to 7 construct and maintain toll roads and bridges in such locations 8 throughout the Commonwealth as it deems are in the public 9 interest. Such toll roads and bridges may be constructed with 10 current revenues or through the issuance of general obligation 11 bonds of the Commonwealth. All tolls collected on a given toll 12 road or bridge shall be pledged to the repayment of any bonded 13 indebtedness used to construct said road or bridge. Whenever the 14 debt incurred to construct a given toll road or bridge has been 15 retired, the department may, at its option cancel the imposition 16 of tolls or continue to collect them at the same or lower rate 17 to offset the cost of maintaining such toll road or bridge. Any 18 construction of toll roads or bridges which is financed by the 19 incurring of debt shall be approved by the General Assembly. 20 Section 2. This act shall take effect in 60 days.
