                                     AN ACT

     1  Amending the act of July 19, 1974 (P.L.489, No.176), entitled
     2     "An act providing for a compensation system for persons
     3     injured in motor vehicle accidents; requiring insurance for
     4     all motor vehicles required to be registered in Pennsylvania;
     5     defining compensable damage in motor vehicle accident cases;
     6     establishing an assigned claims plan; providing for
     7     arbitration; imposing powers and duties on courts, the
     8     Department of Transportation and the Insurance Commissioner;
     9     prohibiting certain discrimination; and providing penalties,"
    10     providing for the surrender of registration certificates and
    11     license plates to the State Police.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 401(d) of the act of July 19, 1974
    15  (P.L.489, No.176), known as the Pennsylvania No-fault Motor
    16  Vehicle Insurance Act, is amended to read:
    17  § 104.  Required motor vehicle insurance.

    19     (d)  Obligations upon termination of security.--An owner of a
    20  motor vehicle who ceases to maintain the security required in
    21  accordance with this act shall immediately surrender the
    22  registration certificate and license plates for the vehicle to

     1  [the department] any office of the Pennsylvania State Police
     2  located within the county of the owner's residence and may not
     3  operate or permit operation of the vehicle in this Commonwealth
     4  until security has again been furnished as required in
     5  accordance with this act. A person other than the owner who
     6  ceases to maintain such security shall immediately notify the
     7  owner and the department, who may not operate or permit
     8  operation of the vehicle until security has again been
     9  furnished. An insurer who has issued a contract of insurance and
    10  knows or has reason to believe the contract is for the purpose
    11  of providing security shall immediately give notice to the
    12  department of the termination of the insurance. If the
    13  commissioner or department withdraws approval of security
    14  provided by a self-insurer or knows that the conditions for
    15  self-insurance have ceased to exist, he shall immediately give
    16  notice thereof to the department. These requirements may be
    17  modified or waived by the department.
    18     Section 2.  This act shall take effect in six months.
