                                  A SUPPLEMENT

     1  To the act of November 30, 1965 (P.L.843, No.355), entitled "An
     2     act providing for the establishment and operation of Temple
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related university in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; providing for public support and capital
    10     improvements; authorizing appropriations in amounts to be
    11     fixed annually by the General Assembly; providing for the
    12     auditing of accounts of expenditures from said
    13     appropriations; authorizing the issuance of bonds exempt from
    14     taxation within the Commonwealth; requiring the President to
    15     make an annual report of the operations of Temple
    16     University," making appropriations for carrying the same into
    17     effect, providing for a basis for payments of such
    18     appropriation and providing a method of accounting for the
    19     funds appropriated.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The following sums, or as much thereof as may be
    23  necessary, are hereby specifically appropriated to the Trustees
    24  of Temple University at Philadelphia for the fiscal year July 1,
    25  1981 to June 30, 1982, for the purposes and in the amounts as
    26  shown:

     1     (1)  For educational and general expenses.....    $71,600,000
     2     (2)  For cost of student aid..................      3,018,000
     3     (3)  For instruction - Doctor of Medicine
     4          only.....................................      5,435,000
     5     (4)  For operation of dental clinics in the
     6          school of dentistry......................        600,000
     7     (5)  Temple University Hospital...............      2,500,000
     8     Section 2.  (a)  Payments to Temple University on account of
     9  the appropriations for all items, as provided in section 1,
    10  except for instruction - Doctor of Medicine, shall be made on
    11  the basis of costs during the fiscal year.
    12     (b)  Payments for instruction - Doctor of Medicine only shall
    13  be made on the basis of full-time students enrolled at the rate
    14  of $7,465 per student.
    15     Section 3.  If necessary, Temple University may transfer
    16  funds among the appropriations listed in section 1, clauses (1)
    17  and (2): Provided, That the aggregate amount transferred into or
    18  out of each appropriation during the fiscal year shall not
    19  exceed 5% of the amount specifically appropriated for that
    20  purpose.
    21     Section 4.  (a)  Payment to Temple University of the
    22  appropriations herein provided shall be made monthly during the
    23  fiscal year.
    24     (b)  Such monthly payments shall be made in accordance with
    25  the provisions of sections 2 and 3, on the basis of estimated
    26  costs and full-time students enrolled in the Doctor of Medicine
    27  program. The estimate of costs shall be submitted by Temple
    28  University to the Secretary of Education, the General Assembly
    29  and to the State Treasurer not later than 30 days prior to the
    30  date on which such payment is to be made.

     1     Section 5.  Temple University shall apply the moneys
     2  appropriated by this act only for such purposes as are permitted
     3  in this act and shall at all times maintain proper records
     4  showing the application of such moneys. Not later than 120 days
     5  after the close of the fiscal year to which this act relates,
     6  Temple University shall file with the Secretary of Education,
     7  the General Assembly and with the Auditor General of the
     8  Commonwealth a statement setting forth the amounts and purposes
     9  of all expenditures made from moneys appropriated by this act
    10  and other university accounts during said fiscal year the number
    11  of full-time students enrolled in the Doctor of Medicine program
    12  and costs, as provided in section 2, used as a basis for receipt
    13  of any appropriation during said fiscal year. Such statement of
    14  expenditures, and number of full-time students enrolled in the
    15  Doctor of Medicine program and costs shall be reviewed by the
    16  Auditor General of the Commonwealth, and he shall have the
    17  right, in respect to the moneys appropriated by this act, to
    18  audit and disallow expenditures made for purposes not permitted
    19  by this act and to cause such sums to be recovered and paid by
    20  Temple University to the Treasurer of the Commonwealth. The
    21  Auditor General shall also make a determination of full-time
    22  students enrolled in the Doctor of Medicine program and costs
    23  and make certification as to their correctness. In respect to
    24  expenditures made by the university from moneys other than those
    25  appropriated by this act, the Auditor General shall have the
    26  right to review only and he shall file annually with the General
    27  Assembly such information concerning said expenditures as the
    28  General Assembly or any of its committees may require.
    29     Section 6.  A report shall be submitted to the Governor and
    30  the Appropriations and Education Committees of the Senate and

     1  House of Representatives and shall include data for all programs
     2  except the Doctor of Medicine program. The report, to be
     3  submitted prior to September 1, 1982, shall cover the 12-month
     4  period beginning with the summer term 1981 and shall include:
     5     (1)  The following counts and distributions for each term
     6  during the period:
     7     (i)  The definitions and numbers of faculty members employed
     8  full-time, of faculty members employed part-time, of full-time
     9  students enrolled in graduate courses, of full-time students
    10  enrolled in undergraduate courses, of part-time students
    11  enrolled in graduate courses and of part-time students enrolled
    12  in undergraduate courses.
    13     (ii)  Total numbers of undergraduate student credit hours,
    14  divided into lower division and upper division course levels and
    15  of graduate student credit hours divided into three course
    16  levels--master's, first professional and doctoral.
    17     (iii)  Number of different courses scheduled by level of
    18  instruction and the number of sections of individual instruction
    19  at each level of instruction.
    20     (iv)  Number of terms scheduled and the dates thereof.
    21     (2)  For the summer term and the following academic year in
    22  total and for each two-digit Hegis category of instructional
    23  programs in higher education as defined by the National Center
    24  for Education Statistics, United States Department of Education,
    25  a classification of faculty members or other professional
    26  employees by title including: professor, associate professor,
    27  assistant professor, instructor, lecturer, research associate,
    28  librarian and academic administrator; faculty members or other
    29  professional employees under each title to be subdivided by type
    30  of assignment: teaching and nonteaching, and each such set of

     1  faculty members or other professional employees to be further
     2  subdivided by type of employment: full-time or part-time and the
     3  following aggregates for each such subdivided classification:
     4     (i)  The number of faculty and other professional employees
     5  and their full-time equivalence in instructional and
     6  noninstructional functions.
     7     (ii)  The sum of credits assigned to undergraduate classroom
     8  courses and the sum of credits assigned to graduate classroom
     9  courses taught, divided into lower division, upper division,
    10  master's, first professional and doctoral course levels.
    11     (iii)  The sum of undergraduate classroom student credit
    12  hours and the sum of graduate classroom student credit hours
    13  generated; divided into lower division, upper division, master's
    14  first professional and doctoral course levels.
    15     (iv)  The sum of undergraduate individual instruction student
    16  credit hours and the sum of graduate individual instruction
    17  student credit hours generated; divided into lower division,
    18  upper division, master's, first professional and doctoral course
    19  levels.
    20     (v)  Total salary paid for instructional functions and for
    21  noninstructional functions and the amount of this salary paid
    22  for each of these functions from college or university funds,
    23  Federal funds and other funds.
    24     (3)  For each term of the period covered for each faculty
    25  member employed full-time identified by two-digit Hegis category
    26  and title, the report shall contain an analysis of the average
    27  hours per week spent in college or university-related
    28  activities, stating specifically hours spent in undergraduate
    29  classroom contact and graduate classroom contact, hours spent in
    30  preparation, hours spent in research and hours spent in public

     1  service.
     2     Section 7.  (a)  In addition to the above requirements
     3  relative to this appropriation, the report covering the 12-month
     4  period beginning with the summer term 1981, shall include for
     5  all programs of the university:
     6     (1)  Minimum number of credits required for a baccalaureate
     7  degree and for a master's degree.
     8     (2)  Number of bachelor's degrees, master's degrees, first
     9  professional degrees and doctoral degrees awarded in 1979, 1980,
    10  1981 and estimated 1982.
    11     (b)  The university shall report its revenues and
    12  expenditures and present its financial statements required under
    13  the provisions of this act in accordance with "Higher Education
    14  Finance Manual" (1975).
    15     Section 8.  The university shall provide such information as
    16  may be necessary to carry out this act and in such form and
    17  manner as the Department of Education may prescribe.
    18     Section 9.  The university shall report its revenues and
    19  expenditures and present its financial statements required under
    20  the provisions of this act in accordance with generally accepted
    21  accounting principles and procedures for educational
    22  institutions as set forth in "Higher Education Finance Manual"
    23  United States Department of Health, Education and Welfare (1975)
    24  with the exceptions set forth in the Commonwealth of
    25  Pennsylvania Budget Instructions for State Related Universities,
    26  Phase I, Fiscal Year 1981-1982. Credits granted for
    27  nontraditional programs such as CLEP, lifelong learning etc.,
    28  including all related costs and revenues thereof shall be
    29  excluded from the function of "Instruction" and included under
    30  "Public Service."
