        SENATOR GEKAS, JUDICIARY, AS AMENDED, JUNE 23, 1981

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing that certain
     3     competition between individuals and the promotion of such
     4     competition be unlawful and providing specific penalties. for  <--
     5     certain activities related to such competition.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 18, act of November 25, 1970 (P.L.707,
     9  No.230), known as the Pennsylvania Consolidated Statutes, is
    10  amended by adding a section to read:
    11  § 7107.  Tough guy competition.
    12     (a)  General rule.--It shall be unlawful for any person or     <--
    13  corporation to promote, sponsor or to participate OFFENSE         <--
    14  DEFINED.--A PERSON COMMITS A MISDEMEANOR OF THE FIRST DEGREE IF
    15  HE PROMOTES, SPONSORS OR PARTICIPATES in any manner in the
    16  staging of, or the conduct of, any competition referred to as a   <--
    17  tough guy contest or a battle of the brawlers or in any similar   <--
    18  competition.


     1     (b)  Specific penalties.--                                     <--
     2         (1)  The promotion of any competition which is prohibited
     3     in subsection (a) is a misdemeanor of the first degree. Any
     4     person who is or any corporation which is found guilty of
     5     promoting such competition shall be sentenced to pay a fine
     6     of $25,000.
     7         (2)  The sponsorship of any competition which is
     8     prohibited in subsection (a) is a misdemeanor of the first
     9     degree. Any person who is or any corporation which is found
    10     guilty of sponsoring such competition shall be sentenced to
    11     pay a fine of $10,000.
    12         (3)  Any person who participates as a contestant in any
    13     competition prohibited in subsection (a) commits a
    14     misdemeanor of the first degree.
    15         (4)  For each second and subsequent violation of
    16     subsection (a), the penalties provided in this section shall
    17     be doubled.
    18         (5)  Whenever a corporation is found guilty in paragraph
    19     (1) or (2), the chief executive officer of the corporation
    20     shall be liable for the penalties imposed by the court.
    21     (c) (B)  Definition.--For purposes of AS USED IN this section  <--
    22  the phrase "tough guy contest" or "battle of the brawlers" means
    23  any competition which involves any physical contact bout between
    24  two or more individuals, none of whom has had professional
    25  boxing or wrestling experience nor has trained in the martial
    26  arts, who attempt to knock out their opponent by employing
    27  boxing, wrestling, martial arts tactics or any combination
    28  thereof and by using techniques including, but not limited to,
    29  punches, kicks and choking. This term THESE PHRASES shall not     <--
    30  apply to amateur or professional contests SANCTIONED BY THE       <--

     1  PENNSYLVANIA ATHLETIC COMMISSION NOR TO AMATEUR OR PROFESSIONAL
     2  CONTESTS of the marital arts and NOR TO any collegiate or         <--
     3  scholastic boxing, wrestling or martial arts contest.
     4     Section 2.  This act shall take effect in 30 days.
