In the House of Representatives, July 7, 1982 1 WHEREAS, The State Department of Environmental Resources is 2 charged with the duty to establish guidelines and regulations 3 with regard to the installation and use of on-lot sewage 4 systems; and 5 WHEREAS, The State Board for Certification of Sewage 6 Enforcement Officers is charged with the duty to review and pass 7 upon applications for certification of sewage enforcement 8 officers and to administer examinations necessary to determine 9 the fitness of candidates for certification; and 10 WHEREAS, Sewage enforcement officers, certified by the State 11 Board for Certification of Sewage Enforcement Officers and 12 working on behalf of a local municipality, are charged with the 13 duty to determine whether a proposed or existing on-lot sewage 14 system in that municipality complies with the Department of 15 Environmental Resources guidelines and regulations; and 16 WHEREAS, Some property owners have been unable to obtain 17 permits for on-lot sewage systems in some municipalities,
1 thereby diminishing the value of their property and inhibiting 2 growth in those municipalities; and 3 WHEREAS, Some property owners who have been denied permits 4 for on-lot sewage systems or cited for violations of on-lot 5 sewage guidelines and regulations have alleged that those 6 guidelines and regulations are too stringent or that they are 7 not being uniformly applied; therefore be it 8 RESOLVED (the Senate concurring), That the General Assembly 9 hereby directs the Joint Legislative Air and Water Pollution 10 Control and Conservation Committee to investigate the 11 qualifications for sewage enforcement officers and the manner of 12 their selection, the guidelines and regulations established by 13 the Department of Environmental Resources for on-lot sewage 14 systems, and the procedure for assuring compliance with those 15 guidelines, in order to determine if the Department of 16 Environmental Resources guidelines and regulations unnecessarily 17 prevent the use of on-lot sewage systems in some cases and if 18 the enforcement system is adequate to assure reasonable 19 uniformity in the issuing of permits and the identification and 20 prosecution of violations; and be it further 21 RESOLVED, That the committee report its findings to the 22 General Assembly as soon as possible and include with the report 23 of those findings any recommendations the committee believes are 24 appropriate to prevent unnecessary regulations and to assure 25 uniform enforcement of necessary regulations.
