                                     AN ACT

     1  Amending the act of June 18, 1974 (P.L.359, No.120), entitled
     2     "An act creating the Municipal Police Officers' Education and
     3     Training Commission; providing for the commission's
     4     membership, selection, compensation, and removal; providing
     5     for the powers and duties of the commission; providing for
     6     the appointment and duties of the chairman; providing for the
     7     act's applicability to the civil service laws; requiring
     8     training by certain political subdivisions and police
     9     departments; providing penalties for violation thereof; and
    10     making an appropriation," extending the length of time to
    11     complete training and authorizing certain police departments
    12     to conduct training as approved schools.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 6, act of June 18, 1974 (P.L.359,
    16  No.120), referred to as the Municipal Police Education and
    17  Training Law, is amended by adding a clause to read:
    18     Section 6.  Powers and Duties of the Commissioner.--The
    19  duties of the commissioner shall be as follows:

    21     (10)  To certify as an approved school, any police department
    22  having five or more full-time police officers, if in the opinion


     1  of the commissioner, the department has the capabilities to
     2  perform most of the training requirements imposed on an approved
     3  school pursuant to the provisions of this act and the
     4  implementing regulations.
     5     Section 2.  Section 9 of the act is amended to read:
     6     Section 9.  Police Training Mandatory; Penalties.--All
     7  political subdivisions of the Commonwealth or groups of
     8  political subdivisions acting in concert shall be required to
     9  train all members of their police departments hired by them
    10  after the effective date of this act, pursuant to the provisions
    11  of this act.
    12     Any person hired as a municipal police officer by any
    13  political subdivision or group thereof acting in concert after
    14  the effective date of this act shall be at the end of [one year]
    15  two years from the date of his employment ineligible to receive
    16  any salary, compensation or other consideration or thing of
    17  value for the performance of his duties as a police officer
    18  unless he has met all of the requirements as established by the
    19  Municipal Police Officers' Education and Training Commission and
    20  has been duly certified as having met those requirements by the
    21  commissioner, unless the police officer is granted additional
    22  time to complete his training by the commissioner. However, such
    23  persons hired as a municipal police officer will be given a
    24  grace period of two years from the effective date of this act
    25  before he becomes ineligible to receive salary, compensation or
    26  other consideration of thing of value.
    27     Any official of any political subdivision who orders,
    28  authorizes or pays as salary to a person in violation of the
    29  provisions of this act shall on summary conviction thereof be
    30  sentenced to pay a fine of one hundred dollars ($100) or be

     1  imprisoned for a term not to exceed a period of thirty days.
     2     Section 3.  This act shall take effect immediately.
