                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the department to establish,
     3     staff and maintain official inspection stations for the
     4     inspection of certain motor vehicles.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1958 of Title 75, act of November 25,
     8  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     9  Statutes, is amended to read:
    10  § 1958.  Certificate of inspection.
    11     (a)  Fee for certificate.--The department shall charge $2 for
    12  each annual certificate of inspection and $1 for each semiannual
    13  certificate of inspection.
    14     (b)  Fee for inspection.--The department shall charge and
    15  collect a fee of $6 for each inspection of a motor vehicle at
    16  its official inspection station and a fee of $3 for each
    17  reinspection. The department shall utilize these charges to
    18  offset the costs of operating the department's official


     1  inspection program.
     2     Section 2.  Section 4702.1 of Title 75 is amended to read:
     3  § 4702.1.  Limited liability of inspection station or mechanic
     4             or inspector.
     5     An inspection conducted pursuant to section 4702(a) (relating
     6  to annual inspection) shall not be construed as a guaranty of
     7  the safety of any vehicle and neither the official inspection
     8  station issuing the certificate of inspection nor the official
     9  inspection mechanic or department inspector performing the
    10  inspection shall be liable to the owner or occupants of any
    11  inspected vehicle for any damages caused by the failure or
    12  malfunction of that vehicle or to the owner or occupants of any
    13  vehicle involved in an accident with that inspected vehicle or
    14  to any pedestrian injured in the accident unless it can be shown
    15  by a preponderance of the evidence that the failure was caused
    16  by the negligence of the inspection station or mechanic or
    17  department inspector.
    18     Section 3.  Section 4721 of Title 75 is amended to read:
    19  § 4721.  [Appointment of official] Official inspection stations.
    20     [For the purpose of establishing a system of official
    21  inspection stations, the department shall issue certificates of
    22  appointment to privately owned facilities within this
    23  Commonwealth that comply with the requirements of this chapter
    24  and regulations adopted by the department.] The department shall
    25  establish, operate, administer and staff with department
    26  employees a Statewide system of official inspection stations
    27  with a sufficient number of inspection stations in every county
    28  to serve the needs of the county. Until such time as the
    29  department is able to construct an adequate number of inspection
    30  stations, the department may lease existing facilities and

     1  conduct the inspections in the leased facilities. For the
     2  inspection of fleet vehicles, the department shall issue
     3  certificates of appointment to privately owned facilities within
     4  this Commonwealth that comply with the provisions of this
     5  chapter and the regulations of the department. The department
     6  shall issue instructions and all necessary forms to such
     7  facilities. Official inspection stations are authorized to
     8  inspect vehicles and mass transit vehicles and issue official
     9  certificates of inspection.
    10     Section 4.  Section 4722 of Title 75 is repealed.
    11     Section 5.  Section 4727(a) of Title 75 is amended to read:
    12  § 4727.  Issuance of certificate of inspection.
    13     (a)  Requirements prior to inspection.--No vehicle, except a
    14  vehicle held by a dealer or manufacturer for which titling is
    15  not required or a mass transit vehicle for which titling is not
    16  required, shall be inspected unless it is duly registered or
    17  titled in this Commonwealth or in any other jurisdiction. The
    18  certified inspection mechanic or department inspector shall
    19  examine the registration card, title or other document as
    20  specified in department regulations in order to ascertain that
    21  the vehicle is registered or titled or that an application for
    22  title has been submitted by the vehicle owner.

    24     Section 6.  The provisions of this amendatory act shall be
    25  implemented by the Department of Transportation within 24 months
    26  of the effective date of this act.
    27     Section 7.  This act shall take effect January 1, 1983.
