AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for driving under the influence
3 of alcohol or controlled substance.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3731(a) of Title 75, act of November 25,
7 1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
8 Statutes, is amended to read:
9 § 3731. Driving under influence of alcohol or controlled
10 substance.
11 (a) Offense defined.--A person shall not drive any vehicle
12 while:
13 (1) under the influence of alcohol [to a degree which
14 renders the person incapable of safe driving] which affects
15 the person's ability to drive in any degree;
16 (2) under the influence of any controlled substance, as
17 defined in the act of April 14, 1972 (P.L.233, No.64), known
18 as "The Controlled Substance, Drug, Device and Cosmetic Act,"
1 [to a degree which renders the person incapable of safe
2 driving] which affects the person's ability to drive in any
3 degree; or
4 (3) under the combined influence of alcohol and a
5 controlled substance [to a degree which renders the person
6 incapable of safe driving] which affects the person's ability
7 to drive in any degree.

9 Section 2. This act shall take effect in 60 days and shall
10 apply to offenses committed on and after that date.
