                                     AN ACT

     1  Prohibiting the application of certain rates of public utilities
     2     to service rendered prior to their approval.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  A method for the automatic adjustment of the
     6  rates of a public utility shall not apply to service rendered
     7  before the effective date of the rate or the date on which the
     8  rate is approved by the public utility commission, whichever is
     9  later.
    10     Section 2.  As used in this act the term "public utility"
    11  shall mean:
    12         (1)  Any person or corporations now or hereafter owning
    13     or operating in this Commonwealth equipment or facilities
    14     for:
    15             (i)  Producing, generating, transmitting,
    16         distributing or furnishing natural or artificial gas,
    17         electricity or steam for the production of light, heat or

     1         power to or for the public for compensation.
     2             (ii)  Diverting, developing, pumping, impounding,
     3         distributing or furnishing water to or for the public for
     4         compensation.
     5             (iii)  Transporting passengers or property as a
     6         common carrier.
     7             (iv)  Use as a canal, turnpike, tunnel, bridge, wharf
     8         and the like for the public for compensation.
     9             (v)  Transporting or conveying natural or artificial
    10         gas, crude oil, gasoline or petroleum products, materials
    11         for refrigeration, or oxygen or nitrogen, or other fluid
    12         substance, by pipeline or conduit, for the public for
    13         compensation.
    14             (vi)  Conveying or transmitting messages or
    15         communications by telephone or telegraph or domestic
    16         public land mobile radio service including, but not
    17         limited to, point-to-point microwave radio service for
    18         the public for compensation.
    19             (vii)  Sewage collection, treatment or disposal for
    20         the public for compensation.
    21     Section 3.  The term "Public utility" does not include:
    22         (1)  Any person or corporation, not otherwise a public
    23     utility, who which furnishes service only to himself or
    24     itself.
    25         (2)  Any bona fide corporative association which
    26     furnishes service only to its stockholders or members on a
    27     nonprofit basis.
    28         (3)  Any producer of natural gas not engaged in
    29     distributing such gas directly to the public for
    30     compensation.

     1     Section 4.  All acts or parts of acts, are repealed insofar
     2  as they are inconsistent herewith.
     3     Section 5.  This act shall take effect in 60 days.
