                                     AN ACT

     1  Amending the act of May 5, 1927 (P.L.817, No.412), entitled, as
     2     amended, "An act authorizing and regulating the growth, sale,
     3     and distribution of forest tree seedlings, transplants,
     4     shrubs and vines by the Department of Forests and Waters;
     5     regulating the use of such forest tree seedlings,
     6     transplants, shrubs and vines and imposing duties upon the
     7     Department of Agriculture with regard to the enforcement of
     8     this act," adding a provision authorizing the Department of
     9     Environmental Resources to trade surplus tree seed, tree
    10     seedlings, scionwood and grafted tree stock.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 4, act of May 5, 1927 (P.L.817, No.412),
    14  entitled, as amended, "An act authorizing and regulating the
    15  growth, sale, and distribution of forest tree seedlings,
    16  transplants, shrubs and vines by the Department of Forests and
    17  Waters; regulating the use of such forest tree seedlings,
    18  transplants, shrubs and vines and imposing duties upon the
    19  Department of Agriculture with regard to the enforcement of this
    20  act," is amended to read:
    21     Section 4.  Nothing contained in this act shall be construed


     1  to prohibit the Department of [Forests and Waters] Environmental
     2  Resources from selling or from growing seedlings or transplants
     3  to be planted for shade or ornamental purposes on State or
     4  Federal lands, public school grounds, or along the State
     5  highways or from trading or exchanging surplus tree seed, tree
     6  seedlings, scionwood and grafted tree stock with the United
     7  States Forest Service, forestry agencies of other states,
     8  forestry departments of universities and colleges and not-for-
     9  profit forestry research organizations upon terms and conditions
    10  deemed most favorable to State forest interests.
    11     Section 2.  This act shall take effect immediately.
