AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," further providing for the definition
6 of "density factor" and making an editorial change.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Clause (16) of section 2501, act of March 10,
10 1949 (P.L.30, No.14), known as the "Public School Code of 1949,"
11 amended June 22, 1970 (P.L.404, No.132), is amended to read:
12 Section 2501. Definitions.--For the purposes of this article
13 the following terms shall have the following meanings:

15 (16) "Density Factor" shall be assigned for those school
16 districts whether coterminous with a city, borough, town or
17 township or not, whose population exceeds ten thousand (10,000)
18 per square mile as determined by the [Superintendent of Public
19 Instruction from] Secretary of Education on the basis of the
1 records of the United States Census Bureau for the 1970 census 2 or the most recent records of the United States Census Bureau 3 using whichever records show the greater population: Provided, 4 That any school district which was assigned a density factor for 5 any school year prior to 1969-1970, and for any school year 6 thereafter is determined by the superintendent to have a 7 population of ten thousand (10,000) per square mile or less 8 shall qualify for a modified density payment which shall be in 9 the ratio of its population per square mile to ten thousand 10 (10,000) of the amount to which it would have been entitled had 11 its population per square mile exceeded ten thousand (10,000): 12 And, provided further, That any school district which was 13 assigned a density factor for any school year prior to 1969- 14 1970, and for any school year thereafter and as a result of a 15 merger with one or more other school districts becomes a part of 16 a new school district and such new school district is determined 17 by the superintendent to have a population of ten thousand 18 (10,000) per square mile or less, such new school district shall 19 qualify for a modified density payment which shall be in the 20 ratio of its population per square mile to ten thousand (10,000) 21 of the amount to which it would have been entitled had its 22 population per square mile exceeded ten thousand (10,000). A 23 school district qualifying under the density factor shall be 24 paid by the Commonwealth on account of excess expenditures per 25 weighted average daily membership, not to exceed for the school 26 year 1966-1967 one hundred dollars ($100), for the school year 27 1967-1968 one hundred fifty dollars ($150), for the school year 28 1968-1969 two hundred dollars ($200), for the school year 1969- 29 1970 and each school year thereafter two hundred fifty dollars 30 ($250), in excess of four hundred dollars ($400), an amount to 19820H2455B3263 - 2 -
1 be determined by multiplying the excess expenditures by the aid 2 ratio or by three hundred seventy-five thousandths (.375), 3 whichever is greater and by the number of weighted pupils, such 4 amount to be in addition to any other payments for such pupils: 5 Provided, however, a school district qualifying under the 6 density factor may, in lieu of the above payment, elect for any 7 school year to be paid and the Commonwealth shall pay on account 8 of excess expenditures per weighted average daily membership in 9 excess of four hundred dollars ($400) a sum of thirty dollars 10 ($30) per weighted average daily membership, such amount to be 11 in addition to any other payments for such pupils. 12 * * * 13 Section 2.
