AN ACT
1 Amending the act of August 9, 1955 (P.L.323, No.130), entitled
2 "An act relating to counties of the third, fourth, fifth,
3 sixth, seventh and eighth classes; amending, revising,
4 consolidating and changing the laws relating thereto,"
5 providing for the time certain officers take office.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Subsection (b) of section 401, act of August 9,
9 1955 (P.L.323, No.130), known as "The County Code," is amended
10 to read:
11 Section 401. Enumeration of Elected Officers.--* * *
12 (b) All such officers shall be elected at the municipal
13 election next preceding the expiration of the terms of the
14 officers now in office, and quadrennially thereafter, and shall
15 hold their offices for a term of four years from the first
16 Monday of [January] December next after their election and until
17 their successors shall be duly qualified, but in the event that
18 any such officer so elected, excepting a county commissioner or
19 auditor, shall fail to qualify, or if no successor shall be
1 elected, then the officer then in office shall continue in
2 office only until the first Monday of [January] December
3 following the next municipal election, at which time his
4 successor shall be elected for a term of four years. In the case
5 of a county commissioner or auditor, there shall be a vacancy
6 which shall be filled as provided in this act.
