        AS REPORTED FROM COMMITTEE ON MINES AND ENERGY MANAGEMENT,
           HOUSE OF REPRESENTATIVES, AS AMENDED, MARCH 24, 1982

                                     AN ACT

     1  Amending the act of July 17, 1961 (P.L.659, No.339), entitled
     2     "An act relating to bituminous coal mines; amending,
     3     revising, consolidating and changing the laws relating
     4     thereto; providing for the health and safety of persons
     5     employed in and about the bituminous coal mines of
     6     Pennsylvania and for the protection and preservation of
     7     property connected therewith; prescribing powers and duties
     8     in connection therewith; prescribing penalties; and repealing
     9     existing laws," MAKING A REPEAL AND prohibiting the use of     <--
    10     internal combustion engines in underground coal mines.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     SECTION 1.  SUBSECTION (B) OF SECTION 269, ACT OF JULY 17,     <--
    14  1961 (P.L.659, NO.339), KNOWN AS THE "PENNSYLVANIA BITUMINOUS
    15  COAL MINE ACT," IS REPEALED.
    16     Section 1 2.  The act of July 17, 1961 (P.L.659, No.339),      <--
    17  known as the "Pennsylvania Bituminous Coal Mine Act," is amended
    18  by adding a section to read:
    19     Section 286.1.  Internal Combustion Engines Prohibited.--The
    20  use of an internal combustion engine shall not be permitted in
    21  any underground coal mine, EXCEPT THAT ANY INTERNAL COMBUSTION    <--


     1  ENGINE WHICH HAS MET WITH THE APPROVAL OF THE SECRETARY FOR USE
     2  IN AN UNDERGROUND COAL MINE PRIOR TO THE EFFECTIVE DATE OF THIS
     3  ACT MAY, SUBJECT TO AT LEAST TWICE PER YEAR INSPECTIONS,
     4  CONTINUE IN OPERATION UNTIL THE USEFUL LIFE OF SUCH ENGINE SHALL
     5  EXPIRE.
     6     Section 2 3.  This act shall take effect immediately.          <--
