                                     AN ACT

     1  Prohibiting the purchase of certain mass transit vehicles and
     2     prescribing penalties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The following words and phrases when used in this
     6  act shall have, unless the context clearly indicates otherwise
     7  the meanings given to them in this section.
     8     "Local transportation organization."  Any political
     9  subdivision or any mass transportation, port, redevelopment or
    10  airport authority now or hereafter organized under the law of
    11  Pennsylvania or pursuant to an interstate compact or otherwise
    12  empowered to render, contract for the rendering, or assist in
    13  the rendering of transportation service in a limited area in the
    14  Commonwealth of Pennsylvania, even though it may also render or
    15  assist in rendering transportation service in adjacent states.
    16     "Mass transit vehicle."  A self-propelled or electrically
    17  propelled vehicle designed for carrying 15 or more passengers,


     1  exclusive of the driver, other than a taxicab, designed and used
     2  for the transportation of persons for compensation including but
     3  not limited to, subway cars, trolleys, trackless trolleys and
     4  railroad passenger cars.
     5     Section 2.  (a)  It shall be unlawful for any local
     6  transportation organization to specify or purchase mass transit
     7  vehicles which have not been manufactured and assembled in their
     8  entirety within the United States of America.
     9     (b)  It shall be unlawful for any local transportation
    10  organization to specify or purchase mass transit vehicle
    11  replacement parts which have not been manufactured in their
    12  entirety in the United States of America.
    13     Section 3.  Any person who violates the provisions of section
    14  2 shall upon conviction be guilty of a misdemeanor of the third
    15  degree and may be sentenced to undergo a term of imprisonment
    16  not to exceed one year, to pay a fine of not more than $2,500 or
    17  both.
    18     Section 4.  This act shall take effect in 60 days but shall
    19  not apply to any contract awarded pursuant to an invitation for
    20  bids issued on or before such date.
