AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, eliminating the restrictions on the use of proceeds
3 allocated to cities of the first class.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Subsection (d) of section 9511 of Title 75, act
7 of November 25, 1970 (P.L.707, No.230), known as the
8 Pennsylvania Consolidated Statutes, added June 23, 1981 (P.L.98,
9 No.35), is amended to read:
10 § 9511. Allocation of proceeds.

12 (d) Allocation to cities of the first class.--In addition,
13 an amount is hereby appropriated annually out of the Motor
14 License Fund to cities of the first class equal to the
15 difference between the increased amounts allocated to cities of
16 the first class resulting from subsections (b) and (c) and 2% of
17 oil company wholesale revenues from sales of gasoline delivered
18 to retail outlets in cities of the first class, as determined by
1 the Pennsylvania Secretary of Revenue in developing the official
2 revenue estimate for the ["]oil company franchise tax [for
3 highway maintenance and construction."] imposed by section 9502
4 (relating to imposition of tax). Such funds [shall] may be used
5 [exclusively] for maintenance, construction or reconstruction of
6 highways and bridges within cities of the first class or for any
7 other purposes by cities of the first class.
8 Section 2. This act shall take effect immediately.
