AN ACT
1 Providing for adoption of capital projects to be financed from
2 current revenues of the Motor License Fund.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the "Highway
7 Capital Budget Act for Fiscal Year 1981-1982."
8 Section 2. Itemization and authorization of Highway and Safety
9 Improvement Projects.
10 The 1981-1982 capital budget projects in the category of
11 Highway and Safety Improvement Projects to be financed from
12 current revenues of the Motor License Fund, are hereby itemized
13 by base construction, land or design phase together with their
14 respective estimated costs, as follows:

7 Section 3. Construction of toll roads and bridges.
8 The Department of Transportation shall have the power to
9 construct and maintain toll roads and bridges in such locations
10 throughout the Commonwealth as it deems are in the public
11 interest. Such toll roads and bridges may be constructed with
12 current revenues of the Commonwealth. All tolls collected on a
13 given toll road or bridge shall be pledged to the repayment of
14 any revenues used to construct said road or bridge. Whenever the
15 costs incurred to construct a given toll road or bridge have
16 been retired, the department may at its option cancel the
17 imposition of tolls or continue to collect them at the same or
18 lower rate to offset the cost of maintaining such toll road or
19 bridge. Any construction of toll roads or bridges shall be
20 approved by the General Assembly. THE DEPARTMENT OF <--
21 TRANSPORTATION SHALL NOT PURCHASE, CONSTRUCT OR MAINTAIN ANY
22 TOLL ROAD OR BRIDGE UNTIL THE ACQUISITION OR CONSTRUCTION IS
23 ITEMIZED IN A CAPITAL BUDGET THAT SPECIFICALLY DESIGNATES THE
24 PROJECT AS A TOLL SUPPORTED PROJECT.
25 Section 4. Funding limits.
26 (a) Since the estimated costs of the projects authorized in
27 section 2 are based on current dollar values, these estimates
28 may be adjusted to reflect escalation from the effective date of
29 this act to the date of awarding of the construction contracts,
30 as reflected in the Federal Highway Administration Composite

1 Construction Cost Index of the United States Department of
2 Commerce.
3 (b) Actual cash expenditures for the projects itemized in
4 section 2 are to be limited in any given fiscal year to the
5 funding available in the appropriations of the annual operating
6 budget of the Department of Transportation.
7 SECTION 5. EXPENDITURE ON OTHER PROJECTS. <--
8 THE DEPARTMENT OF TRANSPORTATION SHALL HAVE THE AUTHORITY TO
9 EXPEND FUNDS AUTHORIZED IN THIS ACT FOR THE COMPLETION OF ANY
10 HIGHWAY AND SAFETY IMPROVEMENT PROJECT ITEMIZED IN ANY
11 PREVIOUSLY ADOPTED HIGHWAY CAPITAL BUDGET ACT.
12 Section 5. 6. 5. Progress reports. <--
13 The Secretary of Transportation shall submit a progress
14 report on all projects in this act July 1 of each year to the
15 Governor, the Majority Chairman and the Minority Chairman of the
16 Appropriations Committees of the Senate and the House of
17 Representatives and to the Majority Chairman and the Minority
18 Chairman of the Senate Transportation Committee and the House of
19 Representatives Transportation Committee. The report shall
20 indicate the latest estimated or actual financial costs, the
21 date of approval by the State Transportation Commission of any
22 program changes, the sources of funds to be used to pay the
23 estimated financial costs and the reallocations of funds made
24 pursuant to section 3. The report also shall indicate those
25 projects contracted for during the preceding period for which
26 Federal funds were or will be obtained, indicate the amount of
27 the contracts and the amount of Federal funds for each and also
28 those projects for which Federal funds cannot be obtained under
29 Federal law.

1 State funds shall not be expended in lieu of available
2 Federal matching funds on any projects qualifying for the latter
3 except with the approval of the General Assembly.

5 All project phase authorization itemized herein shall expire
6 eight years after the date of enactment, except for those
7 project phases completed, under contract for design or
8 construction, or for which the department has initiated land
9 acquisition by making an offer to purchase land or has initiated
10 condemnation proceedings or has claims in litigation.

12 This act shall take effect July 1, 1981, or if enacted
13 subsequently, immediately.
