AN ACT
1 Providing for adoption of capital projects to be financed from
2 current revenues of the Motor License Fund.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the "Highway
7 Capital Budget Act for Fiscal Year 1981-1982."
8 Section 2. Itemization and authorization of Highway and Safety
9 Improvement Projects.
10 The 1981-1982 capital budget projects in the category of
11 Highway and Safety Improvement Projects to be financed from
12 current revenues of the Motor License Fund, are hereby itemized
13 by base construction, land or design phase together with their
14 respective estimated costs, as follows:

19 Section 3. Construction of toll roads and bridges.
20 The Department of Transportation shall have the power to
21 construct and maintain toll roads and bridges in such locations
22 throughout the Commonwealth as it deems are in the public
23 interest. Such toll roads and bridges may be constructed with
24 current revenues of the Commonwealth. All tolls collected on a
25 given toll road or bridge shall be pledged to the repayment of
26 any revenues used to construct said road or bridge. Whenever the
27 costs incurred to construct a given toll road or bridge have
28 been retired, the department may at its option cancel the
29 imposition of tolls or continue to collect them at the same or
30 lower rate to offset the cost of maintaining such toll road or

1 bridge. Any construction of toll roads or bridges shall be
2 approved by the General Assembly.
3 Section 4. Funding limits.
4 (a) Since the estimated costs of the projects authorized in
5 section 2 are based on current dollar values, these estimates
6 may be adjusted to reflect escalation from the effective date of
7 this act to the date of awarding of the construction contracts,
8 as reflected in the Federal Highway Administration Composite
9 Construction Cost Index of the United States Department of
10 Commerce.
11 (b) Actual cash expenditures for the projects itemized in
12 section 2 are to be limited in any given fiscal year to the
13 funding available in the appropriations of the annual operating
14 budget of the Department of Transportation.
15 SECTION 5. EXPENDITURE ON OTHER PROJECTS. <--
16 THE DEPARTMENT OF TRANSPORTATION SHALL HAVE THE AUTHORITY TO
17 EXPEND FUNDS AUTHORIZED IN THIS ACT FOR THE COMPLETION OF ANY
18 HIGHWAY AND SAFETY IMPROVEMENT PROJECT ITEMIZED IN ANY
19 PREVIOUSLY ADOPTED HIGHWAY CAPITAL BUDGET ACT.
20 Section 5. 6. Progress reports. <--
21 The Secretary of Transportation shall submit a progress
22 report on all projects in this act July 1 of each year to the
23 Governor, the Majority Chairman and the Minority Chairman of the
24 Appropriations Committees of the Senate and the House of
25 Representatives and to the Majority Chairman and the Minority
26 Chairman of the Senate Transportation Committee and the House of
27 Representatives Transportation Committee. The report shall
28 indicate the latest estimated or actual financial costs, the
29 date of approval by the State Transportation Commission of any
30 program changes, the sources of funds to be used to pay the

1 estimated financial costs and the reallocations of funds made
2 pursuant to section 3. The report also shall indicate those
3 projects contracted for during the preceding period for which
4 Federal funds were or will be obtained, indicate the amount of
5 the contracts and the amount of Federal funds for each and also
6 those projects for which Federal funds cannot be obtained under
7 Federal law.
8 Section 6. 7. Matching Federal funds. <--
9 State funds shall not be expended in lieu of available
10 Federal matching funds on any projects qualifying for the latter
11 except with the approval of the General Assembly.
12 Section 7. 8. Expiration date. <--
13 All project phase authorization itemized herein shall expire
14 eight years after the date of enactment, except for those
15 project phases completed, under contract for design or
16 construction, or for which the department has initiated land
17 acquisition by making an offer to purchase land or has initiated
18 condemnation proceedings or has claims in litigation.
19 Section 8. 9. Effective date. <--
20 This act shall take effect July 1, 1981, or if enacted
21 subsequently, immediately.
