AN ACT
1 Providing for adoption of capital projects to be financed from
2 current revenues of the Motor License Fund.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the "Highway
7 Capital Budget Act for Fiscal Year 1981-1982."
8 Section 2. Itemization and authorization of Highway and Safety
9 Improvement Projects.
10 The 1981-1982 capital budget projects in the category of
11 Highway and Safety Improvement Projects to be financed from
12 current revenues of the Motor License Fund, are hereby itemized
13 by base construction, land or design phase together with their
14 respective estimated costs, as follows:

13 SECTION 3. CONSTRUCTION OF TOLL ROADS AND BRIDGES. <--
14 THE DEPARTMENT OF TRANSPORTATION SHALL HAVE THE POWER TO
15 CONSTRUCT AND MAINTAIN TOLL ROADS AND BRIDGES IN SUCH LOCATIONS
16 THROUGHOUT THE COMMONWEALTH AS IT DEEMS ARE IN THE PUBLIC
17 INTEREST. SUCH TOLL ROADS AND BRIDGES MAY BE CONSTRUCTED WITH
18 CURRENT REVENUES OF THE COMMONWEALTH. ALL TOLLS COLLECTED ON A
19 GIVEN TOLL ROAD OR BRIDGE SHALL BE PLEDGED TO THE REPAYMENT OF
20 ANY REVENUES USED TO CONSTRUCT SAID ROAD OR BRIDGE. WHENEVER THE
21 COSTS INCURRED TO CONSTRUCT A GIVEN TOLL ROAD OR BRIDGE HAVE
22 BEEN RETIRED, THE DEPARTMENT MAY AT ITS OPTION CANCEL THE
23 IMPOSITION OF TOLLS OR CONTINUE TO COLLECT THEM AT THE SAME OR
24 LOWER RATE TO OFFSET THE COST OF MAINTAINING SUCH TOLL ROAD OR
25 BRIDGE. ANY CONSTRUCTION OF TOLL ROADS OR BRIDGES SHALL BE
26 APPROVED BY THE GENERAL ASSEMBLY.
27 Section 3. 4. Funding limits. <--
28 (a) Since the estimated costs of the projects authorized in
29 section 2 are based on current dollar values, these estimates
30 may be adjusted to reflect escalation from the effective date of

1 this act to the date of awarding of the construction contracts,
2 as reflected in the Federal Highway Administration Composite
3 Construction Cost Index of the United States Department of
4 Commerce.
5 (b) Actual cash expenditures for the projects itemized in
6 section 2 are to be limited in any given fiscal year to the
7 funding available in the appropriations of the annual operating
8 budget of the Department of Transportation.
9 Section 4. 5. Progress reports. <--
10 The Secretary of Transportation shall submit a progress
11 report on all projects in this act July 1 of each year to the
12 Governor, the Chairmen MAJORITY CHAIRMAN AND THE MINORITY <--
13 CHAIRMAN of the Appropriations Committees of the Senate and the
14 House of Representatives and to the Chairman MAJORITY CHAIRMAN <--
15 THE THE MINORITY CHAIRMAN of the Senate Transportation Committee
16 and the Chairman of the House of Representatives Transportation <--
17 Committee. The report shall indicate the latest estimated or
18 actual financial costs, the date of approval by the State
19 Transportation Commission of any program changes, the sources of
20 funds to be used to pay the estimated financial costs and the
21 reallocations of funds made pursuant to section 3. The report
22 also shall indicate those projects contracted for during the
23 preceding period for which Federal funds were or will be
24 obtained, indicate the amount of the contracts and the amount of
25 Federal funds for each and also those projects for which Federal
26 funds cannot be obtained under Federal law.
27 Section 5. 6. Matching Federal funds. <--
28 State funds shall not be expended in lieu of available
29 Federal matching funds on any projects qualifying for the latter
30 except with the approval of the General Assembly.

1 Section 6. 7. Expiration date. <--
2 All project phase authorization itemized herein shall expire
3 eight years after the date of enactment, except for those
4 project phases completed, under contract for design or
5 construction, or for which the department has initiated land
6 acquisition by making an offer to purchase land or has initiated
7 condemnation proceedings or has claims in litigation.
8 Section 7. 8. Effective date. <--
9 This act shall take effect July 1, 1981, or if enacted
10 subsequently, immediately.
