           TRELLO, HEISER AND RASCO, APRIL 27, 1981

        AS AMENDED ON SECOND CONSIDERATION, IN SENATE, JANUARY 26, 1982

                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," further providing for
     5     the membership of boards of managers of houses for detention
     6     of juveniles.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2538, act of July 28, 1953 (P.L.723,
    10  No.230), known as the "Second Class County Code," is amended to
    11  read:
    12     Section 2538.  Management of Houses for Detention of
    13  Juveniles; Appointment of Board; Ex-officio Members.--The
    14  management of houses for the detention and reception of
    15  juveniles under the age of sixteen years awaiting trial, hearing
    16  or judicial investigation, heretofore or hereafter established
    17  under existing law to which this is a supplement or its
    18  amendment or under the provision of any other law of the
    19  Commonwealth, shall be in a board of managers consisting of [six

     1  citizens of the county, at least two of whom shall be women,
     2  appointed by the judges of the court of common pleas of the
     3  county] three county commissioners, the county controller, and
     4  six private citizens, three to be appointed by the president
     5  judge of the court of common pleas and the other three to be
     6  appointed by the chairman of the board of county commissioners.
     7  The commissioners and the controller may appoint persons to act
     8  as their designees for the purpose of attending meetings of the
     9  board and the designees shall have the right to vote at such
    10  meetings. The private citizen members of the board shall not be
    11  officers or employes of the county. The members of the board or
    12  boards of managers existing in the county shall remain as
    13  members of the board or boards of managers created herein until
    14  the expiration of the terms to which they were respectively
    15  appointed. Annually thereafter, they or their successors shall
    16  be appointed for a term of three years. Vacancies occurring in
    17  the membership of the board shall be filled FOR THE UNEXPIRED     <--
    18  TERM by the [judges of the court of common pleas for the          <--
    19  unexpired term] CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OR  <--
    20  THE PRESIDENT JUDGE OF THE COURT OF COMMON PLEAS DEPENDING UPON
    21  WHO ORIGINALLY APPOINTED THE BOARD MEMBER. The members of the
    22  board shall serve without compensation. [The county
    23  commissioners and the controller shall be members ex-officio of
    24  the board of managers with the same rights, powers and
    25  privileges given to and possessed by the six members of the
    26  board appointed by the court.]
    27     Section 2.  This act shall take effect in 60 days.
