                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled
     2     "An act relating to counties of the third, fourth, fifth,
     3     sixth, seventh and eighth classes; amending, revising,
     4     consolidating and changing the laws relating thereto,"
     5     authorizing counties of the fifth class to permit two persons
     6     to hold the office of prothonotary and the office of the
     7     clerk of courts.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Subsection (b) of section 1302, act of August 9,
    11  1955 (P.L.323, No.130), known as "The County Code," is amended
    12  to read:
    13     Section 1302.  How Offices to Be Held.--* * *
    14     (b)  [In] (1)  Except as set forth in clause (2), in counties
    15  of the fifth class, one person shall hold the offices of
    16  prothonotary and clerk of [the court of oyer and terminer and
    17  quarter sessions] courts, one person the offices of register of
    18  wills and clerk of the orphans' court, and one person the office
    19  of recorder of deeds, unless local law applying to such counties
    20  shall otherwise provide.

     1     (2)  The county commissioners of every county of the fifth
     2  class, may, by resolution or ordinance, provide that the offices
     3  of prothonotary and clerk of courts be held by two persons.
