                                     AN ACT

     1  Amending the act of July 12, 1972 (P.L.762, No.180), entitled
     2     "An act relating to intergovernmental cooperation," providing
     3     for a council of governments and its rights and powers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5, act of July 12, 1972 (P.L.762,
     7  No.180), entitled "An act relating to intergovernmental
     8  cooperation," is amended to read:
     9     Section 5.  (a)  A municipality may enter into
    10  intergovernmental cooperation with or delegate any functions,
    11  powers or responsibilities to another governmental unit or
    12  political subdivision upon the passage of an ordinance by its
    13  governing body. If mandated by initiative and referendum in the
    14  area affected, it shall adopt such an ordinance.
    15     (b)  A municipality may join, upon the passage of an
    16  ordinance by its governing body, a council of governments for
    17  the purpose of implementing the provisions of this act.
    18     Section 2.  The act is amended by adding a section to read:

     1     Section 9.1.  A council of governments is a voluntary body of
     2  member local governments.
     3     (a)  A council of governments governing body shall be
     4  composed of mayors and/or other local elected officials from the
     5  governing bodies of the member local governments.
     6     (b)  The rights and powers of a council of governments
     7  include:
     8     (1)  To determine the procedures by which the council of
     9  governments shall operate.
    10     (2)  To appoint a director and staff.
    11     (3)  To enter into contracts of group insurance for the
    12  benefit of its employes.
    13     (4)  To enter into contract for social security benefits to
    14  be administered by the council of governments.
    15     Section 3.  This act shall take effect in 60 days.
