                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," authorizing
     4     appropriations for borough citizens band radio base stations.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1202, act of February 1, 1966 (1965
     8  P.L.1656, No.581), known as "The Borough Code," is amended by
     9  adding a clause to read:
    10     Section 1202.  Specific Powers.--The powers of the borough
    11  shall be vested in the corporate authorities. Among the specific
    12  powers of the borough shall be the following, and in the
    13  exercise of any of such powers involving the enactment of any
    14  ordinance or the making of any regulation, restriction or
    15  prohibition, the borough may provide for the enforcement thereof
    16  and may prescribe penalties for the violation thereof or for the
    17  failure to conform thereto:

     1     (73.2)  Appropriation for Citizens Band Radio Base Station.
     2  To appropriate funds for the establishment of a borough citizens
     3  band radio base station for public service, nonprofit use. Not
     4  more than one thousand dollars ($1,000) may be appropriated
     5  annually for radio equipment and not more than twelve hundred
     6  dollars ($1,200) may be appropriated annually for rental of
     7  facilities to house the equipment in the event no space is
     8  available in existing public buildings. Individuals making use
     9  of such appropriation, including members of organizations making
    10  use of such appropriation, shall not, by virtue of this section,
    11  become employes or agents of boroughs making such appropriation.
    12  Boroughs shall be immune from any civil and criminal liability
    13  arising out of this section, out of their election to make such
    14  appropriation, or out of the actions or negligence of
    15  individuals making use of such appropriation, including members
    16  of organizations making use of such appropriation.
