        AS REPORTED FROM COMMITTEE ON LOCAL GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MARCH 9, 1981

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     injuring or tampering with fire apparatus by prohibiting
     4     obstruction or interference with the operation of fire
     5     apparatus or emergency vehicles.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 3305 of Title 18, act of November 25,
     9  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
    10  Statutes, is amended to read:
    11  § 3305.  Injuring, obstructing, interfering or tampering
    12           with fire apparatus, emergency vehicles, hydrants, etc.
    13     (a)  Willful and malicious acts.--Whoever willfully and
    14  maliciously cuts, injures, damages, or destroys or defaces any
    15  fire hydrant or any fire hose or fire engine, or other public or
    16  private fire equipment OR OTHER EMERGENCY VEHICLE AS DEFINED IN   <--
    17  75 PA.C.S. § 102 (RELATING TO DEFINITIONS), or any apparatus
    18  appertaining to the same, commits a misdemeanor of the third


     1  degree.
     2     (b)  Obstruction and interference.--Whoever willfully
     3  obstructs or interferes with the transportation or operation of
     4  any fire apparatus or emergency vehicle AS DEFINED IN 75 PA.C.S.  <--
     5  § 102, commits a misdemeanor of the third degree.
     6     Section 2.  This act shall take effect in 60 days.
